Parking ticket despite being within the bay lines

Took my nephews to the cinema a couple of weeks ago and have just received a parking ticket for not "parking fully within the lines"

I've tried to look it up on the website but keep getting an error.

I know it's hard to see but the car was fully inside of the lines. It's a bigger car and the spaces are small so it looks tight but nothing was overhanging.

I'm going to ring them tomorrow but am I being unreasonable to refuse to pay it?

Is it not overhanging at the back? As you say it's hard to tell, but it does look like you should have been a foot further forward.

It’s mad and a bit over the top but it will be because the back is over hanging lines and there is space at the front. They will dig their heels in too. Shot because the carpark looks empty.

On the public highway where parking is managed by local authorities the law is AFAIK that as long as the wheels are within the lines then thats ok regardless of over hang. That is for a PCN or Penalty Charge Notice.

I love how these firms call their tickets Parking Charge Notice so they have the same acronym as a real PCN!

Anyway they may have their own rules as in they might count any over hang as being outside a bay but definitely worth checking. I would say to them that the wheels are inside the bay and that you understood that to be rule and see what they say.

@ForMerryPinkCatby parking that far back you would stop anyone behind you from opening their boot. This happened to me the other day returned to my space and couldn’t access my boot. You are over hanging into the he space behind.

that said it’s an empty carpark so they are being petty.

i thought it’d only be over hanging if the wheels were not in the bay. The overhang in your picture looks like the shadow…

It's getting ridiculous now. I take photos every time i park the car just in case. I receive a ticket for no reason.

If I was taking a picture of a car overhanging a space, I would take it from an angle where the line was perpendicular to me so it clearly showed the actual overhang.

Looks like the bumper is overhanging, and intruding in the space behind. It doesn’t matter where the tyres are. The car has to be wholly within the lines. But the angle of the photo isn’t clear, so I think you can appeal.

If the car is as big as you say then judging by the back wheel position and the space at the front of the bay in the 2nd photo then the car would be overhanging at the back.

Even in my much smaller car if I left that much space at the front I’d be close to the lines at the back!

Sick of these fucking cowboys. Whether you're in the lines or not the car park is empty. It makes no odds to anyone. You could have parked sideways across three bays and no one would have been inconvenienced. It's worth a go challenging it because it's really not clear from the photos imo. I guess it depends how much time and energy you want to devote to it. Which of course is what they Bank on.

The 'evidence' doesn't show you over the lines.
They needed a different angle to show that.

I know it kinda looks like it's overhanging at the back but it really wasn't.

Something I know has worked in the past - contact the shop / restaurant or whatever you were there to go to and ask if they can get it cancelled as you're a loyal customer and don't think you did anything wrong. They will sort this sometimes with the parking firm.

I would not pay it and let it go to court, I would expect to win. Over the last two decades I’ve probably had half a dozen spurious fines, various ones I remember are overstaying (literally couldn’t get out the car park cos of a queue). I’ve won every single one. The only time a rep turned up from the parking company to the court he was so embarrassed by it and felt even worse from the dressing down by the judge. All the others cancelled on the day. They’re just trying their luck.

I would fight this one! I really can’t see the problem. The overhang is subjective and if they took it to court it would be up to them to prove the overhang, which if you say it definitely wasn’t then any other pictures they have will back you up!

If that image is the deciding factor, it looks like it was. Appreciate it might be perspective but if it’s the only thing anyone has got to adjudicate on, I guess they’ll go with what they can see

Challenge It.My DP got a letter showing he wasn’t parked within the lines at a shopping centre, when he parked there were no cars next to him. The picture sent showed cars both sides so taken later I assume. He wrote and challenged their version of events, they sent a few letters then it just stopped.Theyre chancers, some people will pay immediately.

This. The fact they haven’t included such a photo makes me think they haven’t got one. I don’t think this would stand up in court without such a photo as otherwise you could argue it’s perspective.

i admit it does look like you are very close to the end of the bay but not necessarily over. You have my sympathies, I have a long estate and if I’m in at one end I’m overhanging into the road way on the other end. 🤷‍♀️

i wouldn’t pay. I’d do a popla appeal which you’ll probably lose as I swear they’re in cahoots with the parking firms. Don’t ignore any letters, etc. I have known someone get a ccj who ignored everything. But I would happily have a day in court and hope that the judge agreed with me.

i have had six tickets all for not parking in a marked space in a gravel car park with no marked spaces. I haven’t paid a single one and have emailed saying I will happily fight it in court. Haven’t been taken to,court. This was over ten years ago so nothing will happen now. Email, don’t ring. So you have evidence of correspondence.
