Land purchase what type of solicitor

Not sure the best place to post but we are looking to purchase part of our neighbours garden, they want to sell as finding it hard to maintain. But of course we want to ensure it’s all above board but clueless as where to start and who to speak to
any help appreciated!

Think of it as a normal house purchase but just no house - any standard conveyancer should be able to handle it - it is basically deciding

  • price
  • any covenants (e.g. do they still need access over it to put out the bins type thing!) - you want to minimise those, so don't suggest unless it comes up...
  • contract
  • sort out payment
  • register the land with land registry...
  • anything relating to mortgage companies...

you can I think either hold the land as a separate title deed, or have it merged into your current one if contiguous...

they will also need someone similar to look out for their interests, and to split their title deed etc.

you might need a RICS chartered land surveyor if defining the new boundaries is tricky - otherwise it is simply drawing outlines on a map!

Definitely get a surveyor to draw up the plan. The Land Registry is really picky about those.

Decide who's going to put up the new fence, by when and who is to maintain it.

There's no need for a contract. You all sign the Transfer once you've agreed it, the money changes hands and it's dated.

It's generally best that the seller's solicitor drafts the Transfer in these circumstances.

Access etc is rights not covenants. If I was your neighbours I'd want a covenant adding that it can only be used as garden land.
