Has anyone else been following the lindsay clancy trial? What is everyone thinkin? I dont think she done it

Thought it had to be unanimous in the Commonwealth on a murder charge.

So yes - if they can not get to all 12 jurors then that is a mistrial. And probably the commonwealth would seek to retry her again - which is a huge expense as well as traumatic for all involved (witnesses - many of whom are being sued by the Clancys in the civil courts for medical negligence in their treatment of LC)

Yes that's what I am saying. Badly written. No - full unanimity is required in this case.

I watched the Zoom call. It really is crazy in the USA wouldn't get that here. Wonder how long the SJC will take. The judge said she would issue a written order.

I’m watching it now. Can somebody tell me in simple terms what the Supreme Court can do? What are their options?

It has been stated that she is heavily medicated by Reddington. Which would make sense given they have since diagnosed her as Bi-Polar.

the notion that meds make you drowsy or unresponsive is nonsense. She’s not sedated.

And how she reacts 2/3 years after the event with continuous treatment and therapy bares no reflection on how you might react without any of those things hypothetically in your imagination.

I am unsure if she can direct Judge Sullivan to revoke his declaration of mistrial and ask that he sends them back to deliberate which would be on Tuesday. They are quite strict on timing in Mass - say in comparison to the Mushroom cook trial in Victoria where if memory serves they did deliberate on a weekend

She may confirm that Judge Sullivan's decision stands and its a mistrial.

I don't think she can direct that one of the alternates is swapped in - that would require all deliberation start again

There is a statutory code that the prosecution referred to about when a juror is deemed unfit and that doesn't seem to apply here. If I were to bet, I'd say she will affirm the mistrial declaration.

Or maybe there will be the opportunity for full argument on matter of the lone juror in front of the SJC by both counsel...

I don't like that the system allows one member of a jury to cause a mistrial on purpose if they are feeling particularly contrary. I'm not saying this person is, but one could.

That's the nature of juries...

People are allowed to be true to their conscience I guess.

Here they would likely allow 11-1. Which is more reasonable.

The jury will be incredibly relieved to be dismissed. I feel sorry for every one of them, having to endure that trial. I imagine they'll be well supported in the aftermath.

People can hold out for lots of reasons. On one I was on, a fellow juror made a show of not agreeing with the majority decision because she fancied another (paid) day off work. She mysteriously did an about turn the next day on a Friday afternoon.

Exactly. Absolutely horrendous. Those poor wee souls.

Did she actually say that she fancied another paid day off work? If so, why didn't the foreperson report it, or you?

What will happen then? is it a new trial?

Will there be another jury? How will that even work?

I feel sorry for the 6 alternative jurors just sitting in a room this whole time.
