But the jury have the (very very unlikely) option of finding her not guilty of the murders? The prosecution need to meet the burden of proof that she did in fact commit the murders.

Which is utterly ridiculous. She did kill the children. They are dead because she killed them. So if the jury were to find her not guilty of murder and to wholeheartedly acquit her it would be a miscarriage of justice.

She should never walk free again, whether that be because she is sentenced to prison or death or committed to a psychiatric institute for the rest of her life.

You've stated your case Neverlookinthemirror. Now prove it. Beyond all reasonable doubt.

Lindsay Clancy isn't going to walk evr again as she's a paraplegic.

So she's going to be found also not guilty of intentional murder?

If the former, not guilty of murder by insanity, she'll still be legally required to be institutionalised until she is no longer deemed a danger to society. That could last a lifetime.

It could last a lifetime, but it could also last a very short amount of time (when compared to the time that she would otherwise spend in prison in America). Deanna Laney and Dena Schlosser were found not guilty by reason of insanity and were both out in a few years. Although Dena is now institutionalised once again, Deanna is still free. Not everyone is institutionalised for the rest of their life.

But that's in Texas.

I believe the only requirement to be released in every state is that the person must be determined to no longer pose a threat to anyone.

There are 51 separate judicial systems in the US.

This crime took place in Massachusetts.

Yes, I know. And Massachusetts is notorious for having a more lenient criminal justice system. Texas is typically actually harsher.

They don’t have to prove that she killed them. this is what people aren’t understanding.

They have to prove beyond reasonable doubt that it was murder.

She killed them. That is beyond reasonable doubt as she’s admitted it, they’ve said as part of the defence that her having killed them is not what the trial is about.

So why are people still harping on about reasonable doubt when the reasonable doubt applies to actual murder, not the fact that she killed them. She did.

You are completely wrong about this and I suggest you look at the facts of the criminal case again.

Even LCs lawyer has said ‘she killed her 3 kids’ in court.

It is not about whether she did it it is about whether she was criminally insane at the time.

There are four outcomes of this case.

Jury finds her not criminally responsible. Jury finds her guilty. Jury finds her not guilty (very small possibility but still a possibility). Or the jury hangs.

Beyond a reasonable doubt at the moment? Surely you’d be going not guilty on the evidence provided and that’s JUST on the commonwealth’s case. Reddington hasn’t even called a witness yet.

https://www.mass.gov/doc/9200-lack-of-criminal-responsibility/download

there is still the option for the jury to find her not guilty entirely, however slim.

You’re right. The stipulation of facts means she’s agreed to these facts to streamline the trial.

That is not a guilty plea.

If during the trial there is reasonable doubt that she committed the offence, regardless of the stipulation of facts, capacity or not, she can be found not guilty.

It is very much all to play for for the defence. He’s doing an excellent job during the prosecutions witnesses alone of establishing that the timeline is janky and adding in reasonable doubt that she did it. Because she may believe she did.

But if on the floor of the trial reasonable doubt that she did enters the minds of the jury, she may be found not guilty. And THAT is what people are talking about but misusing legal words to do it.

MH nurse here.

I truly believe she was suffering from a psychotic episode, probably triggered by sleeping deprivation, stress, the changing of meds, wrong treatment, etc.

The husband should be held accountable for leaving a woman who disclosed thoughts to harm her children alone with them. Really sad case.

For gods sake, would you stop banging on about TikTok, acting like anyone that poses questions is so thick they’re depending on social media talking heads for their information. Like there aren’t intelligent women on this thread, and many other areas of life, asking very valid questions from their own review of verifiable evidence.

Exactly the same thought and belief all those tiktok people have about themselves and other on there.

And identical to how every conspiracy group, about every topic, describes and defends themselves.

I don’t understand your comment. What exactly are you trying to say?

Prosecution- LC did it
Defence - LC did it
LC- I did it
Tiktok watching mumsnetters- Definitely the husband!

I don’t know if this threads link will work but this video… he just looks like such an uninterested parent, they’re at some kind of museum. She’s pushing the buggy. Holding the baby and watching the two older ones. While he’s standing back - could be another man from another family!

He's totally disengaged. Hands in pockets.

placemats · Today 09:24

The prosecution seem to be the defence team, so much so, I had to double check at the beginning.

placemats · Today 09:53

Understand that the video may well show that Lindsay Clancy was an engaging mother with seemingly no visible signs of psychosis, but the opposite effect is immediate.

It clearly shows how unsupported she was.

NeverLookInTheMirror · Today 10:11

Thing is though a video is just a snapshot, and interesting to see how people are interpreting it differently. So they’re saying that she was engaging with no visible signs on the one hand, but on the other are saying that he’s clearly not supportive because he looks disinterested. But how big a part of their lives does that video really show.

I imagine any one of us have a snapshot moment in our lives which would give people room for judgement if displayed on a public platform, even though it might not have any bearing on the entirety of our lives.

placemats · Today 10:16

Which begs the question as to why the prosecution showed the video.

So it shows his complete character and we can judge him on it. But not LC, we can’t judge her on one clip? Do you see the irony behind what you’re saying?

You are right, I wouldn’t assume LC wasn’t suffering from any type of depression. But I also wouldn’t assume PC was so disengaged he’s probably going to kill his children and frame his wife.

He’s not on trial. The video isn’t there to show how unsupportive he was, it’s there to show how clearly not suffering from psychosis she was, if you take that one clip on face value.

placemats · Today 10:52

But I also wouldn’t assume PC was so disengaged he’s probably going to kill his children and frame his wife.

Have I ever suggested that PC did that?

No you asked people not to judge LC on one clip. In the same breath you asked everyone to judge PC.

This clip is doing the rounds already and this is exactly what people are saying about him. To say no one checks out on a family activity for certain periods is disingenuous and only used to suit a narrative.
