Maintenance from ex now living in Spain

Hi, has anyone successfully managed to get maintenance payments. My ex husband moved to Spain to retire he is paying a very minimal amount of maintenance less than £100 a month. With the cost of living and a 15 year old I’m finding it now very hard to manage with this amount of money I just Wondered if anyone has claimed through the Spanish courts?

Essentially though, nothing you can do. Quite rightly the Spanish courts aren’t dealing with ex pats CMS issues. They have enough of their own family breakdown issues to be dealing with

CMS will have nothing to do with it - you’ll need to take him to court. Yau’ll need to check with a solicitor if a maintenance order made in the U.K. courts can be enforced in Spain.

I think an additional issue is his retirement. Does he have a pension income or is it all lump sum? As far as I know its income that matters not savings unless they amount to exceptional wealth.

Yes his retirement would even complicate matters if he wasn’t in Spain
