Private parking firm refused POPLA code after reminder notices only

Parking Charge Notice 1

  • Alleged contravention: 14 December 2025
  • I did not receive the original Notice to Keeper.
  • Reminder Notice received: 9th June 2026, dated 8th June
  • This was the first correspondence I received regarding this Parking Charge Notice.
  • I promptly contacted CUP Enforcement to explain that I had not received the Notice to Keeper and requested that a late appeal be accepted.
  • To date, I have not received a substantive response or any evidence relating to this Parking Charge Notice.

Parking Charge Notice 2

  • Alleged contravention: 24 December 2025
  • Notice to Keeper dated: 8 May 2026.
  • CUP Enforcement has provided a certificate indicating that this Notice to Keeper was posted on 8 May 2026.
  • I did not receive this Notice to Keeper.
  • Reminder Notice dated 8 June 2026 received 9th June 2026 was the first correspondence I actually received regarding this Parking Charge Notice.
  • I appealed promptly upon becoming aware of the Parking Charge Notice.

Despite explaining that I had not received the Notice to Keeper, CUP Enforcement has refused to consider my appeal on its merits and has refused to issue a POPLA verification code, stating only that the appeal period has expired.

what can I do without a POPLA code? Where do I go from here?

You can't appeal if the appeal period has expired. They can't provide you with a code - you have not received the Notice to Owner and so haven't submitted a representation. The code is generated when they reject your representation.

You're looking at it from the wrong point of view - you cannot appeal against the contravention so there is no point in trying to at the moment. Instead, you need to appeal against the fact that you didn't receive the Notices from them.

With Council issued Penalties, you'd need to wait for debt to be registered at the Traffic Enforcement centre (TEC). You'd then receive an Order for Recovery of Unpaid Debts. You could complete it, submit a WItness statement and formally state that you didn't receive the Notice to Owner. If the TEC accept what you've said, the case would be reverted back a couple of stages. The charge would be reduced and another Notice to Owner would be sent to you. There should be plenty of info online to assist you.

Don't pay the charge if you want to submit a Witness statement. If you pay, the case will close.

I don't know if the process is exactly the same with private parking firms. All I can say is that repeatedly emailing them to appeal, won't make any difference. The Witness statement process exists for people in your position who have not received some of the formal Notices.
