Car 'crash' - I know who's at fault but who will get the blame?

I'll try to be brief. I was going from a 3 lane road around a large roundabout at the end of a motorway onto the motorway. I was in the middle lane marked straight on or right, other car in 3rd lane marked right.

The other car was already behaving like a bit of a dick, traffic had been stop start for a while and he'd been weaving in and out. As we were queueing for the roundabout he was a car or so behind me in the next lane.

We set off and the outer cars were going faster, I assume he didn't realise my lane also turned right (other cars had gone straight on) and at the beginning of the turn tried to swap lane to undertake the car in front and hit me. It was pretty minor, just surface scratches.

Swapped details but he insists I cut across his lane and his passenger agrees. I didn't, I've driven this most days for 10 years and know to take that turn wide and slow because of idiots.

Honestly, I wouldn't have bothered repairing the car, it's stress I don't need but now it needs to go through the insurance. No other cars stopped, does his passenger count as a witness so 2 against 1?

I do think the location of the scratches might tell a story, I think they'd have been different if I cut him up but maybe not.

Any thoughts? Another issue I don't need!

The damage on your cars might indicate what happened but failing that, it’ll be 50/50.

To add - the witness is taken into account but not seen as independent so wouldn't necessarily affect the outcome in this situation.
