Now, in English law if the culprit can't be identified then both would be acquitted, or so I believe.

Not necessarily. On the one hand the prosecution has to prove guilt beyond all reasonable doubt but on the other the other hand if they’ve conspired to commit the crime or who did it they could still be found guilty
