Item bought from Zavvi, arrived damaged, paid through clearpay, now bank dispute.

I bought a christmas present for my son around the 10th of december from zavvi. It was supposed to take two days to arrive but didn't arrive until the 22nd of december.

He opened at christmas day but didn't take it out of the packet until the twenty eighth of december when we discovered it was broken. it was an action figure that was £140(!) and both its arms were broken off at the joints.

I contacted zavvi that day and heard nothing from them. I tried again on the 6th of january but there is no way to contact them. No phone number, only an online form that they never responded to.

A few days ago I got an email back from them saying that due to issues in their warehouse, they are moving all the operatives there and they are shutting down all support tickets. So basically they just shut down my question and i've still not heard from them.

Unfortunately, I decided to pay through clear pay, which I paid off within a few days.

But because of that, when I try to contact clear pay, they say that because the item actually arrived there's nothing they can do. They only deal with claims for items that never arrived.

So I try to do a charge back through my bank.But again, because I paid with clear pay, the bank have set up a dispute with clearpay, not zavvi 😮‍💨 and clearpay are disputing it.

I can't return the item to zavvi because they aren't responding to me and if you look at trustpilot at their reviews are absolutely dire, I don't trust that I would get the money back even if I posted it back to them.

My bank has temporarily sent me the 140 pounds back and my son keeps asking if he can order another toy, but I don't know what to do as they may take that money back, if clear pay fights it then, I would be down two hundred and eighty pound after buying another toy.

Any advice?

My advice to anybody reading this would be never to buy anything from zavvi, especially using clear pay.

I know its a very niche situation but ajyone been through similar?
