Would this get the delivery driver into trouble?

Got an Ocado shop this morning which included a quite expensive tub of ice cream. When I unpacked (immediately) I noticed the ice cream wasn’t properly frozen. It wasn’t completely defrosted but was soft enough to be able to squeeze the tub and was very mushy. It’s in the freezer and has since refrozen. Not sure whether it’s ok to eat. I know a lot of food can be defrosted and refrozen but not sure about stuff containing cream.

I’m sure Ocado would refund me if I raised this with them but I’m not sure if this would be considered the fault of the driver - did he unpack it too soon or store it incorrectly - and if so would they follow it up with him? Anyone know? I really don’t want to get him into trouble so reluctant to raise it.

Just request the refund they will do it and probably won’t even check first. I’m sure the delivery driver will be fine unless you say it looks like they did it on purpose

Im not sure how Ocado works, but if anything is wrong in my Asda/Tesco delivery (broken, missing) I just put a claim in for a refund. The driver has never even crossed my mind.

Edit - just to clarify by broken I don't mean broken biscuits etc just leaking milk or burst yogurt etc, basically inedible.

Of course it's not the drivers fault. Ocado supplied the van and if it's not cold enough then it's the company's problem.

They'll refund you no problem. I had this with meat and fish and I think it could be due to poor temperature management.

I doubt it was something the driver had done, more likely an equipment failure. You might not be the only one with part defrosted items if his freezer was dodgy.

It was expensive and will probably not re-freeze properly, with ice crystals and stuff.

The only time I’ve ever I’d really bad food poisoning was from ice cream that had been refrozen so I would avoid

and not the drivers fault as I understand they don’t pack the vans anyway
