Will UC backdate this far?

Dd was given the higher care rate of dla in august last year. Previously she only had the middle rate.

I have just found out that uc give a higher amount for the disabled child element in this case, rather than the standard.

I have updated u but will they backdate the disabled child element that far?

Yes, they should.

"They should backdate extra payments to the date your child’s entitlement to the qualifying disability benefit started, regardless of the reasons there was a delay in them finding out about your child’s disability award. There is no need to show that you had ‘special circumstances’ for telling them late"

Yes, they are supposed to. It’s considered “official error” so no backdating limits. You shouldn’t have had to inform them as UC already know how much DLA you were awarded.

Thank god, its been solved going forwards and now I am just waiting to hear back from the decision maker about backdating but they dont know how long it would take. That's dd's school uniform accounted for! Could cry xx
