Pre-charge Police Bail question

Asking for a friend who I know well.

They were arrested October 2024 following a police report of alleged stalking and harrassment from their ex partner.

Phone was seized and they were due to report for bail last week but this was extended as there is a delay in phone download…. They’ve been given an extension date til next week (3 months) - if they had found the evidence, would they re-arrest and resume interview or wait till the bail date? No real answer online for them.

There is no definitive answer.

The only thing I can say is that phone downloads and the subsequent data processing is likely to take much longer than 3 months unless we're talking serious crime and danger.

The bail conditions might even get lifted (pending further investigation) and the person could be re-arrested, interviewed, bailed again, charged or NFAd at any point during the investigation.

The Lawyer should be chasing the status of the case and updating their client - that's the only way to gage what's brewing.
