Hello! If someone crashes into you when you are stationary- is it always the other party's fault?

No

Nope

Thank you, not what I was wanting to hear! Someone has crashed into me on a country lane. I drive a Tesla which I am led to believe will show I was absolutely stationary at the time of impact, and I was hoping that would make things unequivocal!

Why were you stationary? Were you at the side of the road?

Any chance of cctv at a nearby house / buildings or where you in the middle of nowhere ??

Just a narrow lane where there wasn't space for two cars to easily pass. I pulled into a passing place, and they came flying round the corner and didn't have time to position properly, and smashed into me. I know I wasn't actually moving but am waiting for the Tesla report to (hopefully) confirm as much.
