Pre settled status

Im british, and my partner has got a pre settled status, we met and he came over here so we're together for about 4 years, when he turns 5 years of him living here he can apply for settled status. we got a baby, if we get married before it, will they allow it? what will happen then? i'm just really scared if they don't allow him to stay here with me and the baby and send him back to his country, instead of accepting his settled status.

By pre-settled, do you mean he has leave to remain and then is planning to apply for indefinite leave to remain/settlement?

I can’t see how marriage would do anything but strengthen his application. A key aspect of applying for settlement is demonstrating a family life in the UK. Importantly, he already has a (British) child who knows the UK as home.

The most important thing is doing exactly what they say in terms of meeting deadlines and gathering key documents and proof. The best thing I did was to hire an immigration advisor via a solicitor’s office. She was able to tell me exactly what was needed to support my application and exactly how it needed to be organised and submitted in a filing system, even when the actual application wasn’t very clear on the documentation they needed.

He can only apply to settled status after he’s lived here for 5 years.

Him having pre settled status won’t stop you from
being able to get married now. You can marry now or after he gets settled status. That won’t affect whether or not he is offered settled status.
I understand your worry - once the 5 years pass, he can apply for settled status and he will get that as long as 1) they can find a satisfactory record of his residence status through his national insurance number, or 2) he can evidence his whereabouts for the past 5 years (council tax letters, bills, bank statements etc covering the past 5 years).
I have done the evidencing option and all was fine. I’ve also helped friends get it through the other route and that was also fine. Do not worry
