Financial consent order. Do we HAVE to do Form A?

If we aren’t using a solicitor and don’t need mediation/have agreed on the financial consent order, do we have to do Form A (which says we have to do mediation)?

Its so confusing.

Yes, or one or other of you can go after more settlement when they decide they want a bit more money.

But that’s the whole point of the D81 form.
So neither of us can do that.

we both agree on the D81 so can’t understand the need for the Form A

(Sorry should have mentioned the d81 form to start with)

No, you don't. We did the financial split ourselves, used the data required on form a to check what was needed, but didn't fill it in. I created a spreadsheet, asked XH for his information and completed D81. All signed off okay.

Thats really helpful, that’s what I’m gearing towards and it would explain why Form A doesn’t make any sense to me.

Thank you.

Actually did you mean form A or form E? I got them confused. E you don't need to do, A you do and yes it doesn't make sense. I can't remember which boxes to tick but if you Google it there is some advice and also the court service were helpful as I missed something from the form.

We didn't. The judge signed it off no problems even though I hot the lions share.

Ask on legal or on divorce/separation board. I'm sure I've seen posts there saying that you don't have to complete it but then it would allow for one party to come back and claim more money years later.

Fourmagpies · 19/10/2024 21:17

You don't need to fill in the bits about mediation. Just the bits at the beginning, tick some of the boxes, the address for correspondence and sign it - from memory so I can think that was it. It didn't make sense.

We didn't. I sorted all that out without a solicitor and sent it to court, after a bit of a delay because the judge needed more information, it was granted. We were both in salaried jobs at the time.
