Credit card- am I classed as homeowner?

Tulip2478 · 10/08/2024 20:12

A really stupid question!
If I am married but only my husband is on the mortgage and the deeds of the house but i am not, am I classed as a homeowner in the context of applying for a credit card?
The mortgage was started after we were married and I contribute to around half of it if that makes a difference.
I am not very savvy on these matters!

This is a joke right?!? Tell me it’s a joke - why aren’t you on the mortgage and deeds. Sort that out now! - not savvy doesn’t begin to cover it.

No technically you aren’t a home owner.

You have given me a cold rush of blood to the heart OP. Please come back and say you’ve sorted this.

35965a · 10/08/2024 20:28

No because you don’t own the home

If this is not a joke and not a troll, you OP have bigger problems that what label should be applied to you by a credit card company.

JoalGk · 10/08/2024 20:33

I would say. It’s complicated.
For tax reasons you would be considered a home owner as the home is an asset of the marriage, even if you aren’t on the deeds. I got hit with stamp duty for just such a reason when I bought a house to rent out, even though I wasn’t on the deeds.

Starlightstarbright3 · 10/08/2024 20:34

Why are you not on the mortgage or deeds?

from what i have read on here you can get some sort of notification put on the deeds … someone more informed will be along to help

Also to add why is the credit card going in your name ? But not the mortgage

Pigeonqueen · 10/08/2024 20:35

Well technically if you are married you’ll be entitled to half the martial assets if you split up - and that would include the house- so yes I’d put down home owner. But really you should be on the deeds and I would get this changed asap. Doesn’t matter if you’re working or not.

DangerDangerHighMoisture · 10/08/2024 20:35

No of course not

The reason they ask is so they know if you default and they can get a CCJ they can put a charging order on your house. It’s not complicated at all, OP doesn’t own her home.

This is definitely a legit post. I have not seen a conveyancy solicitor, I don't actually know what one is.

Thanks for all your replies, not sure why people would think I'm a troll. I don;t want to get into it too much but basically I made a thread v recently about my H possibly being financially controlling. I learnt I am not on the deeds or mortgage. He takes over every aspect of the house so I have very little knowledge of how things work. I am trying to become more financially independent and was applying for a credit card in case of emergencies, its for myself not the both of us.

Do you work op ?

Does the wages go into joint account ?

I would stop this for now .

Do you have children ? Child benefit .

LittleYellowCloth · 10/08/2024 20:58

Everyone, this is definitely not a troll - Tulip is in an abusive and coercively controlling relationship. Please help her rather than trollhunting, which is against guidelines anyway.

H told me its because when he applied for the mortgage I was mostly a stay at home mum earning very little and working 20 hours a week, so the bank wouldn't allow it. I'm not sure if that's true or not. I don't dare question him about it again because he blew up at me last time and stormed out the house.

How do you mean you learned you’re not on the deeds or mortgage? Didn’t you realise this when you bought the house but didn’t apply for a joint mortgage?

I’m glad you recognise this is financially controlling behaviour, if you left as you’re married you’re entitled to half the equity in the house, see a solicitor, get away from this awful man.

JackJarvisEsq · 10/08/2024 21:00

They ask so they came determine whether they can take a Charging order (or inhibition if you’re in Scotland) if you default on payments so in this context no you are not a home owner

You can but my H said this isn't possible as I earn too little.

Ok, are you working now? Do you have an income you have access to?

You can put anyone on the deeds.

It’s good that you’re realising you’re being financially controlled.

she’s entitled to half the assets if she can get at them. If her name isn’t on them, there are plenty of ways he can hide them.

OP, what are you doing about getting away from this guy?

In terms of the card, you could just say yes - under the circs I would ring CAB, explain your situation and get their advice.

This is almost certainly not true of the mortgage, it is most certainly not true of the deeds. Plenty of non-working partners are on both.

This is financial abuse OP.

savoycabbage · 10/08/2024 21:04

He's lying right to your face.

Cobblersorchard · 10/08/2024 21:04

You know your situation @Tulip2478
You are being abused.

Not everyone that isn’t on the mortgage is though. My husband isn’t on our mortgage or deeds- he can’t be due to his bankruptcy. We can’t have any financial associations as then we’d both be fucked. It doesn’t impact what he gets if we divorce though, he’d still get his share (but not 50/50 as I put in all the enormous deposit and it’s been ring fenced).

DH puts homeowner on forms though including credit cards. He’s not renting and they don’t actually seem to care.
