PCN from Phone & Pay parking

My DS has had a PCN from Civil Enforcement Ltd for £100 (reduced to £60 if paid in 14 days). He is 17 and only recently passed his test. He parked in a car park using Phone & Pay as the only option. He didn’t have the App so tried to phone them but kept getting cut off after entering his card details. He was in an area with not great signal but managed to phone me and I downloaded the App and paid for him. The App also had to verify my payment card before actually taking the payment.

All this took longer than the 10 minutes grace period given hence a parking charge has been issued. It seems really unfair to me. We paid for the parking and actually the minimum period of parking was 4 hours and DS only parked for an hour and a half so they’ve more than had their money!

Has anyone successfully appealed in a situation like this? Any advice?

Yes I have appealed a parking fine when the machine was out of order and the app wasn't working. I took a screenshot of the error message on the app and a photo of the out-of-order machine and sent it to them when they issued a fine. They agreed to cancel the fine. I think it was the Apcoa app, if that helps. Good luck, it seems unfair that they have fined him just because he took longer than 10 minutes to pay.

@Inastatus yes do appeal. You lose nothing by doing so and they do seem to have been very unfair in charging a penalty. Good luck!
