Lucy Letby denied leave to appeal

Just heard on the news Lucy Letby the convicted serial killer has been denied leave to appeal. Good decision I think. She should stay behind bars for the rest of her life.

Can someone who is very familiar with the case and who thinks she is guilty rebut this?

Not someone who just thinks she's guilty and is one of the STFU and stop defending baby killer types, but someone who followed and read a lot of stuff?

I'm interested in all of it but particularly the part which shows the layout of the room which suggests she would have had extremely limited opportunity to do anything to Child A and it would have been incredibly risky.

Also just to add, I'm not asking someone to refute it because I'm saying it can't be refuted, quite the opposite, I'm open to learning.

They have a cap on how much they pay an hour depending on the expert

In a case like this, I really can't see Legal Aid refusing funding for an expert on central points in the prosecution. In fact we know they did have an expert but chose not to call him, probably because he would not have helped the defence case.

No, Operation Hummingbird is reviewing lots of notes of babies that were potentially cared for by Letby. As part of this review a third baby with a high insulin level was found. The investigation into this baby is on going. No further information has been released.

Unfortunately these attacks would have been quick and easy to commit. All she needed for baby A was a syringe of air in her pocket. She had access to his IV when she gave him medicine.

Nope. It's fact. She's a serial baby killer. The worst in recent times in the UK.

And many would agree, she deserves to rot and suffer. Nothing about the voice of reason and due process, thanks.

”Probably because he would not have helped the defence case” is a leap of logic. There are potentially myriad reasons why experts weren’t called. You can’t assume no one was called because none of them would have helped the defence case. Particularly when we know there is an expert, who literally wrote the air embolism in neonates paper on which a massive part of the prosecution case depended, who refutes the idea that these babies died of, or presented with, air embolism.

Either this potential expert witness is dodgy across the board and would present as such in the stand, in which case that would have helped the defence anyway by greatly undermining the prosecution’s air embolism evidence, or his knowledge and research is solid, which would help the defence because, again, he refutes the prosecution’s idea that these babies died from air embolism. In fact, it’s odd that the defence didn’t call him either, and instead relied on his paper from 1989. Why didn’t they call him?

The fact is we don’t know why witnesses weren’t called by the defence, but we can’t leap to the conclusion that it’s because there was literally no one who could or would help the defence, when we know that isn’t the case.

I understand that this is an emotive case. Nonetheless, we all live under the same justice system and we should all want it to be rigorous and accountable. Miscarriages of justice do happen, there are several examples in recent years of nurses being imprisoned for similar crimes only to be later exonerated. We have to be careful and thoughtful about these things and not get side tracked by anger and disgust. Yes, she should rot in prison if she did do it, but reason and due process is there to establish that.

And she's been found by a court of law, in a trial lasting 9 months by 12 independent jurors, to be a serial child murderer.

Appeal judges have looked at her case twice and have good reasons for denying leave to appeal, no doubt. Can't get much fairer than that.

I wonder if her parents will now move closer to Bronzefield now that their daughter is incarcerated there.

Then again, it is possible she could be moved to another prison at some point.

There is still the Supreme Court, where many previous miscarriages of justice have been heard. I don’t have a fixed opinion on her guilt or innocence, but I do get concerned when I see people screaming “burn the witch” in a context where there are legitimate questions that were not raised at trial but could still be heard in court. This is about much more than LL. It’s about the integrity of our justice system which we all live under and that should be important to all of us.

I'm sorry for your miscarriage of justice.

It will be interesting to see what happens come 10th June, when the retail starts for baby K and any further possible convictions for related cases that are currently being looked at.

She wasn't found guilty of all of them, was she. Despite experts saying all those babies were harmed, the "court of law" did not find her guilty for some of them.

So who was wrong? The experts or the jurors?

I refer you to @IbisDancer‘s previous post:

Legal aid is not unlimited funds. It has strict fee caps which has resulted in many experts refusing work as well as a drop in 26% of criminal defence solicitors willing to work. It’s not much good to have say £4K to pay the costs of an expert when the expert’s minimum fee to do research, analysis and attend court is £30k (hypothetical example).

The Law Society recent published a report stating that the system is near collapse and this past December, the High Court ruled against the government for their cuts to criminal legal aid.

The real question is what will happen at the retrial in around 10 years, once Dewi Evans dodgy testimony is discredited and the medical evidence is more thoroughly and honestly evaluated.

Poor parents, having a daughter whose a child serial killer. Can't imagine how they're feeling. Maybe they will come to terms with it, if they haven't already.
