Permanent exclusion

My son was permanently excluded from school 5 months ago I have been fighting it ever since as they were discriminating him and manipulating suspensions. I took it to an independent panel amd they quashed the decision of the governing body and directed they review the exclusion again because of how flawed it was. At the independent review they completely made up a new lie that my child strangled another child, they have literally re wrote incident forms and got the child to re write their statement nearly 5 months down the line saying the strangling took place, they have submitted these to the reconsideration panel, surely this is not allowed.

If it's obviously been rewritten months later then I'm sure it won't be taken seriously. How have they discriminated against him?

It’s incredibly difficult to be permanently excluded from school. Ask for parenting help.

How old is he?

Does he have SEN?

Impossible to give proper advice without those facts!

How do you know they re-wrote evidence? Nobody I work with would ask a child to change a statement, it is a breach of basic safeguarding practice.

What are your reasons for fighting the PEX? It sounds like the current school is not working for your DS (and vice versa!) and there will be a fresh start for him elsewhere. It’s important to work with the school to help your son.

Do you want him in a school that doesn't want him and you think lies about him though? Might be best to focus on his next school.

If you are talking about an IRP, then they can quash an exclusion for admin errors. I've seen it happen.

(I was a clerk many years ago..)

As per DfE guidance, the governors (or IRP) should not review evidence not seen by the original panel unless there is good reason

Strangling is a good reason. And if statements have been written, then they will be admissible ime.

Were you offered a managed move?

I would focus on getting your dc into appropriate provision.

It's almost impossible to meet the criteria for p ex these days, so your dc must have either done something VERY serious or there is a long history of behaviour policy breaches.

Perhaps you should reflect?

I have the originals from his pex folder they've submitted a new one and they have been re wrote

So has he been violent/assaulted other people at school or is that totally made up?

His has been disruptive he has adhd but his had no help or support whatsoever, I refused off site direction because it was 2 hours away on the bus

Maybe look at why his behaviour met the threshold for permanent exclusion and was upheld by the government body initially? You don't get permanently excluded for minor reasons. And it's a HUGE amount of work for a school so they don't issue them easily.

His 13 and yes he has adhd

At the initial permanent exclusion meeting the governing body upheld the permanent exclusion otherwise there would have been no IRP and no decision to quash?

I’m not sure it’s likely that the governing body will reverse their decision. Maybe time to focus on his next placement.

Is he medicated for ADHD? This is something you must urgently consider doing if not, the right medication is transformational.

His had 1 fight the strangulation allegation was made up on the spot in the independent review panel after they proved there wasn't enough evidence to exclude they made up a new reason, they know they've fuxked up and are trying to cover their tracks

It sounds like the relationship has broken down with this school now. I would focus on where he is going to move onto. Speak to the LA about that and how they can support you there.

I'm fighting it because its on his file and will effect him getting into other schools and colleges

Things 'on their file' are a myth. Don't worry about it.

I really wouldn’t worry about what is or isn’t on his file. If he’s been out of school for 5 months, he needs a school place asap. Ask the LA to help get him another school place asap.

You can't just walk into a new school with this in your file though, they shouldn't be working anywhere near children when they are making up lies on the spot and re writing incident reports to include something that didn't happen, I've reported them to lado and ofsted it's very disturbing

Forget about what's on file. Your ds is entitled to an education. The current school isn't going to take him back and make a successful job of educating him. Cut your losses and move on.

He needs a clean start. I'd focus on getting him some support so the same doesn't happen again.
