Notice period and final paycheck

Quick question (and posting here for traffic). My company had to pay me for the whole contractual notice period even if my last day is before that, correct? HR isn't talking to me, and all I know is that apparently my last day is a few days before my actual last as per my contractual notice period.

Did you resign, were you made redundant, did a contract end? What actually happened?

They pay you for the days worked unless there's something complex involved like redundancy.

I resigned, and in my resignation letter I gave them what my last day (as per my contract) would be. AFAIK they can't go and decide when's my last day my own accord. It has to be a negotiation /conversation.

So let’s assume your notice is 4 weeks.

Did you give a date 4 weeks away and they have shortened it, or did you give a 5 week notice and they’ve shortened it to 4?

I gave a notice of 4 weeks, and they shortened it to 3/2 (as I've been told two different things, neither by HR).

Hi OP, your post is a bit confusing. Could you confirm the exact date you resigned, how much notice you gave, how long is your contractual notice period and your last day of employment? If any of those dates don't match up, could you explain why? That would help provide an answer.

My contract says 4 weeks. So I resigned the 13th, with a last day (as per my contract of the 10th). I gave 4 weeks notice.

One manager said my last day was the 5th. I asked if the other week was "gardening period" and she said yes, but that HR would be in touch.

Her manager said on a later day that my last day was this week.

I only have 2 days of unused holiday.

Just confirm back to them, in writing, that

  • Your last day as per contract is the 10th.
  • You expect to be paid to the 10th.
  • You will be taking the 9th and 10th as your accrued holiday.
  • Can they please confirm working arrangements for the 2nd to the 8th - i.e. do they expect you to be in the office or is it paid “gardening leave” as per your previous conversation.

Spell it out just like that.

Thanks that would just about work as my new contract starts from the 8th (moved it based on what my manager said) but it's been radio silence basically for the past weeks! Management just keeps saying "HR will be in touch". It's been two weeks and nobody has officially (as in written form) acknowledged my resignation.
