Speeding fine

Hi,

I received a speeding ticket a few days ago- a notice of intended prosecution. I have 28 days to confirm I was driving, or name who was driving,

the problem is the offence was almost 2 months ago and we’re genuinely struggling to remember who was driving. We both use the car. It was also around the time that my dad was dying ( he died 6 weeks ago) so that whole time is s blur.

we’re 90% sure that dh was Driving but 90% isn’t enough!! The photographic evidence is useless and doesn’t show the driver as it’s dark.

if I don’t nominate a driver I’ll be summoned to court and potentially receive £1000 fine and 6 points.if I nominate dh there a chance I’m wrong in which case I’m perverting the court of justice!!! I’m stuck!!

neither of us are bothered about taking the rap. I just don’t want to create trouble for myself. WWYD

I'm no xpert but I thought you had to be notified within 14 days, is that a myth?

Perverting the course of justice is lying on purpose to protect yourself or others. It's not being 90% sure of the driver!!

How would they even find out if you were wrong? I imagine this isn't a massively uncommon situation where people share a car, and as long as it's not going to look like you said DH for a reason (like you've had multiple speeding tickets before and so don't want another one because you'll get banned or something) then I doubt it will be an issue.

It went to the lease company first as they’re the registered keeper

We could contact police and explain that we’re not sure but I’ve read about people who’ve done similar and have ended up with more points and a higher fine

You're overthinking this. You are not intentionally trying to pervert the course of justice and if you can't tell who was driving the police won't be able to - or care, if the fine is paid and nothing else dodgy going on.

Do you don’t think that they’d investigate further? Im so worried. I’m worried that they’ll have other photos that contradict who we thought was driving?

You’re overthinking this. If one of the people registered to drive the car owns up, they will be satisfied.

Do you have Google maps on your phone or did you take any photos that day? I think there's a way with Google maps to find where you were on a certain day and if you take any photos on your phone they will be location stamped...

Just put down the person who was most likely the driver.

The police will not look into it any further.

A PCJ charge has to be "knowingly", this burden of proof wouldn't apply in your case because you are not knowingly giving false or misleading information.

Yes, it’s dark though so you can’t see who the driver is at all. Would the police have other images that we could view?

You're not being serious are you?

OP unless you already have 6 or 9 points on your licence I suspect they wouldn't investigate it further. You're not deliberately putting the wrong driver down.

I think you've got a legitimate question here.

Have you searched for the notice online to see if there are colour photographs?

If you still can't identify the driver, I would call the police force who issued the NIP and explain that due to it having to be reissued because of not being the registered keeper that you don't know who was driving, and see if they can pull better quality footage from the camera. If not, can they advise you as to what to do.

Yes, they will have colour photographs of it. The black and white ones they send you are only like that because it's on a printed letter.

You might be referring to publicised cases where the spouse of a politician declared themselves to be the driver when they knew the information to be false in order to avoid their spouse taking the points.... not the same as 'we are 90% sure it was DH.. 6 points at stake but no one is avoiding a ban'

I have called to query a fine before and actually the person I spoke to was lovely. I would get in touch if you are at all unsure.

@NerrSnerr they don't care who was driving as long as they get their money. Tonnes of people take points for others.
