Speeding fine

Hi,

I received a speeding ticket a few days ago- a notice of intended prosecution. I have 28 days to confirm I was driving, or name who was driving,

the problem is the offence was almost 2 months ago and we’re genuinely struggling to remember who was driving. We both use the car. It was also around the time that my dad was dying ( he died 6 weeks ago) so that whole time is s blur.

we’re 90% sure that dh was Driving but 90% isn’t enough!! The photographic evidence is useless and doesn’t show the driver as it’s dark.

if I don’t nominate a driver I’ll be summoned to court and potentially receive £1000 fine and 6 points.if I nominate dh there a chance I’m wrong in which case I’m perverting the court of justice!!! I’m stuck!!

neither of us are bothered about taking the rap. I just don’t want to create trouble for myself. WWYD

In these circumstances I'd just put DH. Its incredibly unlikely that anyone will follow up on it.

My worry is that if I put dh but then there us a higher quality image that contradicts that, I’ll be in worse trouble. In those circumstances, do you think we would be allowed to reconsider the driver?

Would they though? I can't see how they can provide those images if the have better quality ones available. I think that you are overthinking too.

If there was a higher quality image they would have used it.

Plus, these things are transactional. They send a notice, you respond, they issue fine/points/speeding course whatever it is and it's done with. It's practically an automated process. Nobody is looking into it that deeply unless another crime has been committed.

You definitely would be in worse trouble if you put the wrong driver and they found out. It's an offence to provide the incorrect driver details.

As long as you've responded in some way within the timeframe and you've done everything you can to find the correct driver, you're not committing a crime.

Is there a likelihood that one of you would more likely be caught speeding than the other? In our case, I'd say if the same happened, the higher probability would be that it was DH driving. I'm acutely aware of speed limits and less likely to get caught speeding.

Realistically, if they had better photos they'd have sent you better photos. If you think, in all likelihood, that your DH has a 90% chance of it being him, then put his name down.

If in the extremely unlikely event they came back to you again, I would definitely be using those photos as evidence of it being impossible to tell.

Whoever you tell them it is will just automatically be sent either a fine or more likely the opportunity to attend a speed awareness course. I'd almost be tempted to say it was me to go on the course - so many people I know that have been on them said they were really interesting! (sorry OP - not helpful I know!)

If you don’t know/ not sure who was driving you will have to go to court and explain this to the magistrate. I worked at a camera unit. This was the policy

The photos taken are to identify the vehicle not the driver. Cases like this had to be heard in court. Don’t know what the outcome will be. That’s up to the magistrate on the day. Not helpful is it but that’s what we said to anyone in this position who rang 🤷‍♀️

Have you checked all your messages for that day? Not just between each other, but to other people as well? May provide the answer as to who was doing what.

Are either of you likely to have to do anything more than take the speed awareness course, if not I can't imagine there would be any further investigation into it, the amount of people caught speeding, there wouldn't be time. Just put DH as you sound pretty sure it was him. If one of you has points already it might be a bit more difficult and I would want to be sure though

I'm sorry about your dad.

My husband received a speeding notice when he was travelling to visit his dying brother. He apppealed, gave the police a copy of the death certificate, and they cancelled the notice. You could try doing that.

From what I recall, it was about 3 years ago, they did go to court for it, so I think you're right. But they won due to not being able to name who it was.
