Speeding fine

Hi,

I received a speeding ticket a few days ago- a notice of intended prosecution. I have 28 days to confirm I was driving, or name who was driving,

the problem is the offence was almost 2 months ago and we’re genuinely struggling to remember who was driving. We both use the car. It was also around the time that my dad was dying ( he died 6 weeks ago) so that whole time is s blur.

we’re 90% sure that dh was Driving but 90% isn’t enough!! The photographic evidence is useless and doesn’t show the driver as it’s dark.

if I don’t nominate a driver I’ll be summoned to court and potentially receive £1000 fine and 6 points.if I nominate dh there a chance I’m wrong in which case I’m perverting the court of justice!!! I’m stuck!!

neither of us are bothered about taking the rap. I just don’t want to create trouble for myself. WWYD

How did they notify you?

Is this definitely your NIP and not the one that was issued to the hire car company?

I do know of a couple who couldn't tell who was driving and they looked alike from the angle of the photo. They managed to show this and state they couldn't honestly confirm that they knew who it would be.

They got away with it in regards to points (not sure if they paid the fine). They were genuinely willing to take the fine and points but couldn't declare which it was. A close friend of my family but unfortunately I'm not able to ask them for further details, but they were just like you and didn't want to guess/lie about who it was.

Sorry, I think I misunderstood. Yes, I’ve received the NIP. I think it went to the lease company and then they gave my details, allowing the police to send me a NIP

"As we both use the car interchangeably and it was quite a while ago, and either of us could have been driving in that area, we aren't certain which of us it could have been. We are obviously willing to declare who it was when we can confirm and take the points and fine, however if you are able to provide any more photos of the car from that date, it would help us decipher which of us was driving as the photos provided are not clear, unfortunately.

We have done our due diligence on this side, checked diaries and text conversations from the day to see if there is anything that can help us recall who was driving but we have nothing that is able to assist."

We know that only one of us would have been in the car as we’re almost never in the car together at that time of day

That would make sense but from what I’ve read, it would probably just be referred to court

I’d contact them and say it was definitely one of us but we’re only 90% sure it was DH. And so can we say it was him.
they won’t care but your conscience will be clear.
there was a famous court case where an mp’s ex wife took the rap for his misdemeanor. But it was a deliberate attempt to pervert the course of justice which this is most definitely not. They both ended up in jail! You will hear nothing more of it.

Oh, ok so they've definitely sent one to you directly then.

I would ignore people telling you it's no big deal or to just give an approximation of who was driving. It is a legal matter and a potentially serious one.

I would definitely call the police directly and explain the situation and ask for better quality evidence. If you can show you've made reasonable efforts to identify the driver, you'll be in a much better legal position than if you accidentally give the wrong details.

No, I don't. They're barely checking on actual crime, let alone speeding camera photos!

put DH down & hopefully he'll be able to do a speed awareness course & avoid getting points.

what was the speed? What was the limit?

youre not doing it because you have loads of points on your licence, you're giving the answer as truthfully as you can.

They'll have those with a better resolution somewhere. But given it's at night, it might be impossible to work out who it was from the footage.

Do either of you have your timeline on Google switched on?

This happened to me. I just said we cannot be sure who was driving. I think it may have been me. I just got points and a fine. We still don't know who it was.
These days I'd look at my Google maps history and find out that way.

Yeah I reckon you'll need to ask them to pull higher quality footage from the camera then. Those cameras have a very high frame rate, so hopefully there's something clearer they've got on record.

It was actually early morning. We’ve checked everything. It was a bizarre time for us as my dad was dying so our normal routine was all over the place
