Data breach

I’ve have mistakenly been emailed documents relating to a child arrangements court hearing from Cafcass, I rang them and told them and they said they would make a note of the data breach …forward on a couple of months and I have now been emailed the applicants position statement for court by a solicitor

am I right I thinking this is a very serious breach of data? Shall I ring the court and solicitor involved tommrow?

You let them know they sent the wrong documents. They now have a duty to take certain actions as a result. You don't need to do anything. It's not your problem that they screwed up.

It is a serious data breach yes, let cafcas know and they'll follow their process.

The first correspondence came from cafcass months ago, I informed them, then they did it again so I rang them again. This time the correspondence has come from one of the parties solicitor and has the position statement attached of the applicant, the solicitor has copied in the court also

You need to contact the solicitor who sent it to you. They will probably have to report this to the ICO.

Bloody hell that's dreadful! Huge data breach.

Yea contact cafcass and the solicitor to say this is the second time etc.

You could also say, can you please let me know what steps you have taken to report this significant data confidentiality breach?

The solicitor has no duty to inform you of what steps they are taking. They only have a duty to the ICO and the subject person if their rights and freedoms have been affected.

If this breach is because of an error in an email eg ‘annesmith@hotmail’ when it should ‘ann’ it is not going to pervasive and depending on the type of data it may not even be reportable.

in this case the minimum action is for the solicitor to notify the client and the ICO. Then to correct their filings with cafcass.
