Probate and adult social care (Wales)

I believe probate is slow - just wondering how slow?!

A family member had been under the care of adult social care in Wales for a number of years. Unexpectedly, there was money in his account when he died, and probate was applied for. The executor gave details of next of kin (siblings plus children of a deceased sibling).

It’s been 8 months so far. We assumed it would be done and dusted by now …

By adult social care Wales do you mean their money was being managed under appointeeship? I can't work out exactly what you mean sorry.

Yes - the council held his money in a bank account for him. I think his carers would’ve paid for activities with it. Presumably like PIP? He had learning disabilities and couldn’t live independently.

It will take forever. My only experience is helping people in to the apppointeeship system, that's taken up to 18 months! So I imagine they won't be quick to distribute any funds after an RIP, I wouldn't hold your breath.

Probate is taking 6-8 months sometimes longer depending on the size of the estate and whether inheritance tax needs to paid .

Then after you get probate , paying debts, and getting money from companies can take a while as you need to fill in forms , and get the executors to sign such a long process .

Iv just done a family remembers , submitted in January , the courts lost the paper work and then found it and after a lot of chasing got my MP involved where we were finally got probate in July , everything was settled and paid to beneificiaries in October .
