They should have used "sex", but it's a move in the right direction.

I think this is about gender identity, not sex?
The schools are being told to default towards children not socially transitioning to a different gender, e.g. Using the bathrooms of their biological sex, and to adopt a "watchful waiting" approach rather than obliging teachers to use preferred pronouns etc.
