Looking for advice for anyone that knows the law in this area (I know that there is a legal topic but I’m looking for quick answers)

they have just called me and I have the following information

  • they are in a nightclub and have been drinking
  • they have a can of spray paint
  • they are being detained by bouncers whilst they wait for the police on the basis of criminal damage
  • they are on their own as their friends have left

This is absolute bullshit.

You obviously don't live in London.

Im struggling to think of any club where there are unmanned entrances whereby boys can enter without being seen, or without paying to get in. Was it a youth club???

The police and my son confirmed this is what happened

I am honestly so surprised they showed up, and that he was home so quickly. This is why I wanted advice on the detainment - I imagined him being there hours and what would happen when they closed.

Hope everything is ok op

and to those wanting to ensure he got a grilling, he is full of remorse and shame today. Worried about his future and the possibility of a criminal conviction. He is denying causing any damage but was with the boys when it happened and as he was the only one with a bag, he ‘hid the can for them’. I am sceptical, obviously.

You need have many, ongoing conversations about choosing your friends wisely and the impact stupid choices can have on your future. Remind your son that he's not a kid anymore. Stupid choices will have major repercussions.

OP, I think if he really did hide the can for his mates, he needs to be told that it was possibly even more stupid than if he took it there himself.

If you're involved in stupid behaviour, never ever offer or agree to carry anything or hide anything for someone else. This time it was a (relatively harmless) can of spray paint. Another time it might be drugs or something equally serious.

I’ve lived in South East London since 1995. You said the police wouldn’t come for a stabbing, now you’re saying for a gun shot. You’re chatting shit.

Not so full of remorse he admits to his mother what he did though.

im curious as to why a 17 year old boy is taking a bag out with him to a night club. What else did he have in it?

A lot of lads have those cross body bags now, a bit like a bum bag but worn across the chest. Usually used to carry their vapes and mobile phones 😂

They're bouncers, not ISIS. Stop letting your imagination run wild.

Hmm I'll probably get flamed for this but many bouncers are part of organised crime gangs. I've heard and seen bouncers being rough with people or kicking the shit out of them. They also used to control the drug dealing in clubs. Unnlikely in this situation they'll harm your son if they've called the police but lots of nasty bouncers out there.

My favourite phrase with ds for that one was "you lie with dogs you are going to get fleas".

Doesn't matter one jot if he sprayed anything, or just held the can so I wouldn't push for an answer as it doesn't change anything. If he is hanging about with little toe rags where vandalising is their version of a "fun" night out (not so little now, nearly adults who could face adult consequences) he is viewed as a little toe rag too whether he likes it, or thinks its fair, or not.

You probably can't directly change who he hangs about with, but you can start him thinking about and questioning whether this is the kind of crowd he chooses to hang about with now he has had a taste of what those consequences could be for him.
