Can someone work out holiday entitlement please

Son is currently working through a recruitment agency. He is disagreeing with the agency on his holiday entitlement so I would appreciate anyone working this out for him.

He started work on the 23rd of Feb this year. Normal work is Mon - Fri. 37 hours.

The following is what is stated on the agency website regarding holidays.

"Temporary workers are entitled to a minimum of 28 days (Inc Bank Holidays) paid annual leave per year pro rata (based on a 37 hr week). This equates to approximately half a day annual leave /holiday pay accrual for every full week worked. You need to accrue holiday pay to cover all annual leave including Bank Holidays and company closures".

He has worked 32 full weeks, and 4 half full weeks. The 32 full weeks give him 16 days holidays. Is that correct? Up to today he has taken 10 days paid holiday, so should have 6 days left up to today. The agency is saying he has only got one day left of paid holiday. I think they are trying to play him and are insisting he has only one day.

Can someone tell me am I right or wrong.

So just an update on this.

His leave year runs Jan-December. For each full week 39 hours he accrues 4.7 hours holiday. He has 33 full weeks worked and his half weeks add up to 88 hours.

He has already had 10 days leave taken up to this point.

So, can anyone calculate his what he has left to take up to the end of last week?

88 / 39 = 2.256 weeks

33 + 2 weeks = 35 weeks with 0.256 weeks carried forward

35 full weeks x 4.7 hours = 164.5 hours

39/5 = 7.8 hours a day

164.5/7.8 = 21.089 days holiday

28 days x 7.8 = 218.4 hours for the whole year = minimum entitlement

Should have said, Mon-Thurs each day is 8.5 hours. Fri is 5 hours. We have calculated here 9.5 days left to take.

@Tootsey11 ok so his leave has to stay in hours.

164.5 hours for 35 weeks work

He has taken
Easter Monday = 8.5 hours
Easter Tuesday = 8.5 hours
1st May (Mon) = 8.5 hours
31 October (Mon) = 8.5 hours
31st October = 8.5 hours = 42.5 hours
5 days in July - assume 39 hours = 81.5 hours

164.5 - 81.5 = 83 hours left to take. You cannot say this is x days because 2x 8.5 days = 17 hours but 3 x 5 hour days = 15 hours. I would advise taking some leave on Thursday Friday I.e. 8.5 + 5 = 13.5 hours rather than Monday Tuesday I.e. 8.5 + 8.5 = 17 hours.

Note: I think I have worked out the 4.7 hours per week

52.14 weeks less statutory leave entitlement 5.6 weeks = 46.54 weeks.

Statutory entitlement 5.6 weeks x 39 hours = 218.4 hours / 46.54 weeks = 4.69 hours per week rounded up = 4.7 hours a week.
