NHS sick leave question

I understand NHS sick leave/pay entitlements are ‘rolling 12 monthly’ but does maternity leave impact it?

Would they look at the last 12 months e.g., Oct 23 - Oct 22 when calculating sick pay even if a lot of that period was mat leave or does the ‘rolling 12 monthly’ period exclude mat leave.

I have read all the policies and I’m not clear…

No I don't think it counts, ML is treated like annual leave as far as I know

It doesn't count. Maternity leave isn't the same type of leave.

You're entitled to 6 months full sick pay in a 12 month period.

Sorry I think I have worded my question wrong!

I don’t mean does maternity leave count as sick leave rather I was off sick (hospitalised) for almost 6 months of my pregnancy and then had 12 months maternity leave. I have been back full time for several months now but I’m very unwell and worried about what I’ll be entitled to in terms of pay…

Although it’s been around 18 months since I was last off sick as a lot of the last 12 months was maternity leave i’m wondering if the 12 month rolling period is exactly that or not.

If I remember rightly, pregnancy related illness does not count as sickness. I was off work for several months with HG during pregnancy and it was not recorded as usual sick leave.

I was told it includes the maternity leave so it is the last 12 months so would not include before maternity if that was more than 12 months ago. This is because maternity leave is part of continuous employment.

This is how HR explained it to me but my circumstances were different and I was not sick after maternity leave

You're correct that it doesn't count for disciplinary procedures etc but the pay issue is separate. However, it's a rolling 12 months. OP has had 12 months maternity leave so it resets (for want of a better word).

Say OP was off for 6 months, sick. Then 6 months maternity, came back and went off sick. She wouldn't be entitled to full sick pay. NHS is 50%, I believe.

It does not count towards the sickness triggers and they cannot go down the route of monitoring/disciplinary action for pregnancy related sickness. I think it does still count towards the paid sick leave you receive

It's a rolling calendar year. You should get full pay if you were to go off sick at this point. The fact you were on maternity isn't relevant, you were employed like any other employee and would be entitled to pay in like with policy.

Hi Meara I was wondering if you got to the bottom of your question, as it’s taken me 2 days to find this exact question.
I work for the NHS and get 6 months full pay, which I used during my pregnancy as I was a high risk patient. Then on my last 2 months I got half pay.
I’ve been desperately trying to find out if it resets itself after being on maternity leave for 12 months, being back at work for 4 months.
im currently in hospital with sepsis, and my biggest fear is not being paid whilst I’m off, and was wondering if I have gone back to full pay
