If I don't pay my rent will I be evicted?

I'm In a housing association flat upstairs.
I posted a thread the other day so I won't repeat everything but the h/a haven't maintained the land next to my flat and a tree has grown over the fence and is now fully resting on my roof.
Damaging it and it's causing unbearable noise so I can't sleep.
I've been prescribed sleeping tablets and anti depressants from the GP to try and let me sleep through it but it's not a permanent solution as they've only gave me two weeks sleeping tables and I really don't want to take anti depressants as my only issue is not sleeping due to noise.
As I said in my other thread I've complained and they've said they have 18 months to get this tree cut off my roof-so now I'm waiting till I can do stage 2 complaint then housing ombudsman (which can take months )
My local counsellor hasn't replied to me and I have nowhere else to turn too
Tonight it's blowing a Gale here and I can hear the tiles smashing around -horrific noise again.
I'm so down
If I don't pay my rent what will happen?
How can they charge me rent to live like this

@spookyboooo actually I think if there ever was a good case for withholding rent until a problem is fixed it is this. It’s not like there’s disagreement about the severity of the problem or who caused it. Very serious and not your fault.
Contacting your local paper isn’t actually a bad idea, they lap this sort of stuff up, you’ll probably have to do a ‘sad face pointing at tree’ pic though sorry.
please contact Shelter for advice about rent withholding and the proper way to do it.
(I’m an ex local authority housing officer)

@AnxiousPangolin I'm sorry I don't mean to be rude but there should not be a tree fully resting on my roof
The h/a haven't maintained it in years even tho their policy says it should be trimmed yearly
I pay rent I expect to be able to relax in my own flat and be able to sleep without sleeping tablets or white noise or ear plugs to drown out the noise
It's ridiculous
I'm not exaggerating anything
Would you like if you had a tree on your roof ?
Probably not
Easy to write a paragraph on here when your not in my shoes

Sorry, to clarify, I meant the people telling you to claim the tree is about to fall down or put buckets of water in your house and claim the roof is leaking.

Send photo to local paper and local TV and your MPs office. Put a pic on Facebook. Phone your HA and tell them local paper and local news are coming out to cover the story. PAY YOUR RENT. You must pay your rent, or HA will evict you and nobody will help you then. Good luck, ridiculous situation, should be sorted by end of the week.

Has anyone ever emailed their councillors and had a reply?
How long do you think I should wait to expect a reply ?
Obviously I know they must be extremely busy etc

I've done all the above at various times sometimes singly or in combination. I'd expect a local.councillor to reply within 7 days. Contact your MP via House of Commons, expect reply in 14 days or so. Local papers are always glad of a sad photo, ditto local news. MAKE.A FUSS. HAs are busy and overwhelmed, if they can fob you off they will, they just have too much to cope with. So push it. Health and Safety at your local council should also be notified. Send them a photo too.

In fairness, I've been prevented from sleeping by a mouse in the attic, so I'm sure a tree on the roof would do the same!

I've emailed ours in the past over a couple of issues.

Some are better than others and one even put what times she would be deploying on the website. Like "I can available fir telephone or emails on weekdays between 5 and 7pm".

Get a proper tree surgeon to look at it, his opinion may have more weight than yours with the HA. He should scream Health and Safety, which might ruffle a few feathers. We had a tree surgeon in and he said Health and Safety trumps everything. If tiles come off your roof because of the tree and hit someone they will have more to worry about than a tree.

Tree surgeons aren't cheap, especially if you want a written report, £100's...

Personally, i'd write to the HA, copy in local councillor and MP, stating your concerns including roof tiles hitting passers by.

If you want a councillor or mp to respond you need to also write directly not just cc.

longwayoff · 26/09/2023 21:04

I hope that means you're ok now. Good luck.

spookybooo · 27/09/2023 08:18

I did post yesterday but named landlord so asked to delete...
So yesterday I viewed a house and got offered the house(wooo hooo )
Also yesterday my MP replied saying she had contacted my h/a to ask them to cut this tree from roof ASAP
This morning at 8 am they arrive and say they are here to cut this tree
I can't actually believe it

spookybooo · 27/09/2023 10:07

They removed about 15 branches this size from the roof -no wonder it was so noisy 🙈

Excellent. Glad to know some things are still working as they should. Enjoy your new home.
