Being sued after car accident

My husband rear ended another car a few weeks ago. We were in slow moving traffic at the time and the vehicle in front seemed perfect asides from a scratch and a piece rubber fender falling off. We spent 45 minutes after on the side of the road talking to driver and the police also arrived after the accident.. He seemed fine and didn't mention any pain etc.
Now he's suing saying he's injured...
What are chances he actually is injured or is this inevitably opportunistic ?

He could well be injured, things like whiplash can take a day or two to surface. But equally he may be chancing it. Just let your insurance deal with it, they know all the tricks people will try.

Slow moving traffic but managed to rear end a driver and damage the car? Good for him getting insurance involved, your DH must have been driving like an idiot to cause an accident in slow moving traffic.

Insurance company will deal with. They'll probably want medical evidence in terms of a medical report. Also, they may request proof of attendance at GP or hospital - if driver really has been suffering they'll have been to one or the other.

Thanks everyone. Got a fright when I got the letter but will just leave the insurance deal with it.

Unless you can prove otherwise just let your insurance deal with it. If you believe the collision was a set up, you're going to have to play detective.

I wouldn't sweat it. The damages for bog standard whiplash are minimal now.
