Hi all im completely new to mums net ive recently started an appeal for my daughters dla after the MR was refused. At current im still waiting for dwp to respond to the tribunal they have untill 28th aug. I was just wondering how long can i expect to be waiting for hearing date ? And is it actually worth doing the appeal if its already been refused twice my dwp.

My daughter is currently home schooled from September due to how severe her anxiety now. if she dont manger a school in the future then this money could be so usefull to support her education.

It is absolutely worth going to tribunal!!! A large proportion of appeals are decided in the claimant's favour. DWP are notorious for refusing claims unreasonably. And they rarely change their tune at Mandatory Reconsideration stage, so it's no surprise they decided against your daughter at that point.

How long you will be waiting for the tribunal is entirely down to the backlog in the court system in your area, so you'll need to find someone local to ask. I think the clerk of the court may be able to help you with a very rough estimate.

Do you have someone knowledgeable (charity etc) helping you with the claim? If so, they might be able to tell you about the current tribunal waiting times in your area. If not, this is a good time to try to get someone onboard so they can help you through the tribunal process and make sure things go as well as possible.

By the way, DWP often fails to meet the deadline for submitting info to the court and there is no comeback on them for this. I understand the best tactic is that if they don't submit info by the deadline, you ask the court to make the decision based on the info they do have. Usually the court will not do so, but at least they will then lean on DWP to hurry up.

I went to tribunal for my son a,few years ago as he was getting MRC and LRM
And I knew he met the criteria,for HRC,and HRM under SMI,rules
And I won
It's absolutely worth doing assuming you have the evidence to back you up.

Thank you so much for your replies i think my local citizens advice can help so im going to call them and see what help they can offer its good to know that most decisions are over turned at tribunal stage ive been so tempted to cancle it all but im definitely just gonna give it ago now and get some support from my Gp and chams

I found out on the day but I have heard other have found out through a letter and still.got a,yes so it just depends really.

I’m in the same boat as you! How long did it take to get your tribunal hearing heard & what was the outcome?

I only register my appeal today from the MR being rejected.

Hi! My tribunal for my boy was scheduled 15/11 and I’d applied early February ! Hopefully won’t be too long for you !
does anyone have any info on time taken for back pay ? Award to be put into pay ?
I won the tribunal .. Alas, I was a medic and subsequently a manager for DWP PIP appeals department .. and the form was still declined at MR (HRM) thankfully I knew the law ! I would recommend anybody who feels their children haven’t been awarded what they are entitled to to keep pushing and go to tribunal if it requires !

Good evening. I found out yesterday my MR was declined, I am considering appealing, I feel they have just picked out 'good' points and completely not acknowledged everything else that I wrote. My daughter is autistic, extremely sensory and has many struggles and anxieties but she masks incredibly and it all unravels at home but the MR came back with 'she's needs no extra support than someone of similar age'. If she was awarded my hope was that I could put some activities in place that will help with regulation and grounding. She will be going into year 9 in September and it will be highly likely that I will need to get extra tutoring for her too.
Would you advise to appeal the 2nd decline? Many thanks.

Assuming you do ,yes I would take it to tribunal

@x2boys I sent off reports, school plans, statements. They spoke to school as part of the MR , they didn't ring me but it seems like they've judged it off what school have said.

Hi all,
I have finally received a date for tribunal after waiting 12 months ….
it is a video appeal ….can anyone shed any light on what to expect please?
will the people doing the review know all about my sons medical condition prior to the appeal or will I have to explain it all from scratch?
would you recommend me having a representative with being on video call?
any help would be appreciated

Yes definitely appeal…I got declined and my MR declined so submitted a claim for a tribunal at the beginning of Feb. Someone rang me out of the blue today from DWP and told me she was going to award me after reading over what I’d sent in…she asked me a few more questions and changed her decision from 2 years to 3, I was so happy I cried! I didn’t submit anything extra online, although I planned to send some video evidence. Been trying since April last year, so don’t give up x

Happy for you that you got the right decision in the end! My appeal was scheduled for March 11th but after speaking to my representative it has been postponed (no idea why) just a waiting game now , I’ve been waiting almost 2 years from original application a little while longer won’t make any difference…thank you for the advice x

Hi , I have received a DLA appeal date for my daughter after 9 months.
She used to get MRC and LRM then it was upped to HRC ..
Come to the review last year and it was all stopped , didnt win MM so went to appeal.
I have uploaded multiple amounts of evidence., but keep getting back from DWP sorry we can not change this decision letters every time I submit something. I just feel like giving up.
The school got someone to fill in her form who isnt even senco which is one of the reasons it was stopped which I've told them , and they keep saying she hasnt got an EHCP which I kept asking the school to get as she desperately needs one, it got so bad I've moved her school to where there is an active senco .
They also keep mentioning she has no diagnosis, shes been on the list now nearly 3 years due to covid and is due to be seen in 2025 for ADHD/ASD assessment., shes had melatonin since she was 4 shes 7 now , from pediatrician as she does not sleep nd is up and down all night , running around which means I'm up , she still has quite server toilet needs ect , zero road and safety sense.
I've had another letter today stating they said in section 6 why shes not entitled ' but how can they take it off her with the same merits they gave it ? .
I feel totally overwhelmed and like I'm wasting my time , its exhausting, can anybody shine any light onto this , what to except or am I wasting my time ect .

There isn't anything you can do to speed up the process I'm afraid its a case of how longs a piece of string it will depend on how many appeals they get etc.

@x2boys I know this thread is quite old now but I’m gathering evidence for a tribunal for my friends son. He meets the SMI requirements but don’t know how else to prove it. I did the DLA forms for my friend and they got turned down. (My own children do and get HRM & HRC). I have a letter from school, all medical info and EHCP were sent to DWP
