Can you go on holiday to the US if you had a caution in the past?

It’s one that is now filtered out and doesn’t show on enhanced dbs ( i know this as I didn’t declare it and my dbs still came back fine)

It was in 2007 for common assault

Would it be ok. They won’t check will they? I remember when I got it they said ‘oh you can’t go to America now!’ I’d also not been told there was an option to not accept it - they said if I wanted to get home to my dc I had to have a caution …..

Google says you're ok, you probably have to declare it in your ESTA. If they were that strict I don't imagine they'd let in about 80% of the stag parties that end up in Vegas...

"Offences like failure to appear, causing a disturbance, common assault, and impaired driving are not ordinarily considered in determining your admissibility to the country. In addition, multiple convictions involving crimes which are NOT classified as crimes involving moral turpitude ordinarily do not block your entry."

If OP declares it in her ESTA application she will not be granted an ESTA and will have to apply for a visa.

So i should just keep quiet then ?

Cant believe how much hassle this has caused me I had to wait so long to even apply for work till it was on the filtered list when that changed in 2020.

I was in a DV situation. Constantly hurt. The only time I fought back to get away was this and immediately he called the police on me and I was arrested while the dc were left with him. I was desperate to get back to them . After a few hours I said look what do I need to do to be able to leave ? They said sign this it’s a caution and then you can go immediately so I did 😞

I am so sorry for what happened to you. It’s terribly unfair. I can’t advise about what you should do. There will be information on other travel related boards. Do you have a holiday planned?

I find the DIBB boards (just google it) brilliant on all kinds of US travel advice. They are mainly aimed at Florida travel but not exclusively. I’ve definitely seen questions like this coming up.

You can Google the questions that appear, I’m not 100% sure on the wording but if you can answer no to them you’re fine. I’m pretty sure it asks about serious damage to person or property which you wouldn’t have just got a caution for so I think you would be ok
