What will happen to a senior nurse who has accessed my hospital medical notes and my partners notes without justification please ?

If unjustified access ie. Not required in line of duty then potential disciplinary action. Did they breach confidentiality?

Have you reported it and who to?

There will be an investigation to determine why they accessed it (Eg did you say it's not justified or legally was it unjustified).

Then after outcome of investigation if found guilty they'll face disciplinary. That will be in line with the company policy but could be anything from a warning to sacked.

It may take time.

If you ask your GP they will be able to tell you who has accessed your records, when and why. A trail of data is left everytime someone looks at your records.

Gp can only check their own records ...not hospital ones

@Stichintime the GP won’t be able to tell you anything about hospital records though as they don’t have access to them.

@Dered you should make a complaint, it will be investigated and s/he should be disciplined.

There was a case in the news recently of a doctor who illegally looked at his own son’s medical records.

He was given a suspension for a few days, if I recall correctly.

Someone on our street passed patient details to her boyfriend who was working for some kind of medical selling firm. She was suspended pending an investigation. She eventually attempted to take her own life (failed) but killed her daughter!!! Boyfriend got some sort of fine. Mother in some secure facility crippled after suicide attempt. Tragic story but true. She would have been sacked but guessing the outcome just weighed heavy.

Which organisation confirmed they accessed your records? Surely they are the ones who will tell you what happens next?

ICO is not your route at all.... report to information governance at your nhs hospital Trust....and report to NMC

Who has the breach been reported to? Was the nurse working at the hospital. Who reported it to the ICO. Are risk management andd the nmc aware.

Thank you all . It's out of our hands . The Trust have reported it to ICO I understand
We did not want to cause any trouble , just wanted it to be stopped.
