Following on from current thread . My dh is disabled and the stress of all of this is effect his blood pressure and he's at risk of heart failure. If he dies can I sue the neighbours?

Erm surely not
You can't prove the death and stress is from this

My god I wish to god my neighbours only walked over my garden and that was the only things they'd done towards me and my house. You don't want to know what mine are doing to us and our house if you think that's bad

No.

LadyLolaRuben · 28/03/2022 17:24

No its too subjective and can't be proven.

If things got worse and it was taken to court they would have access to medical records which could show that he is suffering from stress due to them. It would be very hard to prove it was all down to neighbours walking over your lawn though if he were to die.
I know someone who was constantly harassed by their neighbour and died. We all know the neighbour’s harassment must have been a part of it as what he died from is usually brought on by stress. But still it can’t be proven and hasn’t gone to court.
I know much worse neighbour cases than this unfortunately and it takes a hell of a lot to even be taken seriously by the police. Even if they are taken to court the most they’ll get is a restraining order.
You need to tell your neighbours clearly (and have evidence) to stop what they’re doing. They need to be told twice. If they carry on and you have evidence, then go to the police.

I deal with a lot worse cases than this. Ultimately the answer is no.

Just get the fence or hedge.
