Appealing a school place

Hi, we've just bought a house in an area 2 miles from where we are now, I don't drive as I have disabilities, but we would have kept them at the same school if we felt they were well settled. My Ds5 has had his place at the local school accepted but my DD8 has been put on a waiting list. She's had some(quite a few) issues with some people in her class, a couple of weeks ago a boy in her class was repeatedly smacking her on the bum daily, then another girl put her hands around her throat. I am happy with DS's class and his teacher but DD's teacher has not been particularly great and today in class he said that she's 'incredibly behind' not to me, but to her in her class, she's really humiliated, she has dyslexia and is currently undergoing assessments for ADHD(I have it too). It's really upset her, but I'm wondering what chance we would have and what points I would need to make if I appeal to get her into the same school as DS5?

What are your grounds for appeal?
Where is she on the waiting list? Having a sibling there may have pushed her up the list but if there isn’t a place then it’s going to be difficult

So this is an in year application? And the school you want has no spaces in her year group? They are essentially full?
Do you know how long the waiting list is?
Presuming school followed their own admissions procedures correctly then I think you have to focus on why this school would be so much better for your Dd and proving that admitting her ( and potentially taking them over their numbers limits) will not be detrimental to the other students.
