Help! Broken baby gate

Ladies (and gents) please lend me your DIY skills.

My kitchen has no door, as the whole downstairs is open plan. Before he moved out (but after we broke up), my ex’s parents offered to buy us a baby gate for the kitchen. I said yes please that will be lovely but please not one that screws into the wall. I’ll give you two guesses what they bought.
So, ex’s stepdad comes and installs it. I ask, what if it comes off the wall? I’m told it won’t.

It has. I asked my ex if he could arrange it being fixed and he told me sure no problem, after all it’s not safe for DS to be able to get into the kitchen.

That was about four weeks ago, and if I sound bitter it’s because I’ve spent those four weeks running after a 20 month old who’s sole purpose in life now is to run into the kitchen and open all the drawers. I probably should have tried to fix it myself sooner but I rent and I’m worried about damaging the wall further.

What do I do? Just shove a bunch of poly filler in there and shove the screws back in? Help! Blush

Can you take it off completely and replace with one of the ones that doesn't need to screw into the wall? Might be easier
