Cms when 1 child lives with other parent

My ex pays me £30 a month for 3 kids. My eldest has decided to go live with him. I only work part time self employed and don't make a lot so would only have to pay the minimum too. How would cms work this out? In my head he should still pay me £10, but not sure what cms will do. Thanks.

Why does he pay £30 a month ?

WonderWomansBoobs · 18/09/2021 09:23

Self employed...say no more lol

It will depends on your relative incomes.

Say they are both the same for arguments sake. I'm not sure what he declares, but it won't be much

5k a year

that’s silly low even if he was on benefits he would be paying £5 a week. £10 a month per child x3. Being generous he drops to £10x2. Does he really think you can feed and clothe a child for £2.32 a week!

Whywhywhy48 · 18/09/2021 10:04

Is that what CMS have told him to pay?

WonderWomansBoobs · 18/09/2021 10:09

Yes all cms calculated as he was only giving me £20. (Oy £10 extra but it is the principle!)

He gets UCs and self employed income-but again unsure how much he declares.

I see where you getting confused. You have 3 kids you get £10 each.

Child moves in with dad he pays you £20 for 2 left. He asks for £10 from you as now “the absent parent for child 1”.

You pay £10 for child 1 and are left with £10 for 2 kids. Is that what you Both are thinking?

Waxonwaxoff0 · 18/09/2021 10:22

Sounds confusing.

Honestly as it is such a little amount I'd probably just give up on it, he pays for the DC living with him and you pay for the DCs living with you.

SMabbutt · 18/09/2021 10:40

Well he's going to get a shock isn't he. Yes he may end up only paying £10 a month to you but if he thinks having his oldest dc living with him is only going to cost him the £20 a month he's saving in cm he's going to be very much mistaken. Finally he's going to have to pay to support one of his dc properly.

WonderWomansBoobs · 18/09/2021 10:41

@Akire yeah that was my thinking. I've not discussed it with him yet. (Fairly recent development) I just think out of principle he should give me a bit money. (Hate he gets away with paying so little-and he never offers extras like for uniform and he doesn't see the 2 youngest much -twice this year I think)

OP posts:
WonderWomansBoobs · 18/09/2021 10:42

@SMabbutt he is applying for CB so getting £80ish there

WonderWomansBoobs · 18/09/2021 10:42

And whatever UCs give him

I don't think the amount will change... £30 a month is the minimum amount and what the cms says parents on benefits should pay, even if for only one child. So you should still get that amount monthly for the 'additional' child. The other two children cancel each other out, so to speak

VladmirsPoutine · 18/09/2021 11:36

Sorry I don't have anything of use to add but CMS has deemed £30 a month acceptable??? WTF! For 3 kids!?? My goodness!

PumpkinKlNG · 18/09/2021 11:40

Normal amount if someone is on benefits, I was “entitled” to £28 a month for 4 children so I cancelled it.

tminusthirtydays · 18/09/2021 11:51

Also depends on how many nights your child is going to come and stay with you ...

I'm still shocked he pays £30 for 3 children 2bh Shock

Whywhywhy48 · 18/09/2021 12:08

What job does he do? Just wondering as he doesn't declare his earnings to HRMC. If he is getting tax credits he is making a fraudulent claim.

Akire · 18/09/2021 12:23

Id just say call it quits what you save by child moving out will more than make up for anything you have pay back. He thinks he’s getting good deal just paying for one until he realises how much going cost.

WonderWomansBoobs · 18/09/2021 14:17

I'm going to lose over £300 a month because of her moving out. Bedroom tax will come in, lose my uc allowance for her and the child benefit. Obv I lived just within my means so going to have to cut things out (which I'm not quite sure what)

Of course it's not just the money I would rather my eldest still lived with me but they're being very difficult atm so allowing them to make their own choices.

WonderWomansBoobs · 22/09/2021 11:07

For anyone wondering, cms has ruled I pay him exactly the same so it wipes each other out. So he gets £30 for 1 child and I get £30 for 2. Its a disgrace.
