Term time holiday unauthorised-email school?

Hi sorry I know 5 year olds are not allowed holidays in term time and we have had our form back declined for our holiday in June. We are still going as we cannot go during the 6 weeks hols due to hubbys job. Do I email the school before hand just stating he won't be in on those dates or do I leave it? How would I word it? I feel bad breaking the rules but we don't have a choice and it's our first holiday in a couple of years.
He's our eldest and so not had to do this before!

Just email and say he will be absent due to a family holiday
Worst case scenario you get fined

Just respond with a brief but polite 'thank you for your response. I will be going ahead with the family holiday so please mark DC as absent for those dates.'

Schools have no choice in the matter but they will understand.

You need to let them know that your dc will be absent one way or another otherwise they will try to contact you.

Yeah they can't say yes, so just email the dates they'll be off (to save you needing to ring in each morning) and let school handle it per their policy. You may be fined, you may not - some LAs seem more trigger happy than others.

Thank you all for the response. I'm preparing for a fine as think the La are quite hot on that but I will email them and let them know regardless. Thank you Grin

Do you have anything from your husband's employer to say that he can't have leave in the holidays, even just something like an email from his manager? We can't go in the school holidays due to DH's job and ours always gets approved by the school. Different schools obviously but in their approval letters they always copy and paste the line from the attendance laws that says limitations due to work are classed as exceptional circumstances.
