Can a person who lacks capacity to consent to an admission be offered an informal one

It’s on the report I’ve been sent about dd that she lacked capacity to consent to an admission but the offered how an informal one which she turned down.

Are you talking a mental health unit? There are strict criteria for compulsory admissions. If she didnt meet them, they cant force her. But sometimes the staff know someone does really need to be admitted and will try and encourage a voluntary admission.

I think it is part of the process. Because she might benefit from voluntary admission doesn't mean she meets the criteria for compulsory admission at this time. What ever is going on must be hard for you and her, hope she gets the support she needs.

She’s 19 and it was a mental health unit a few months back. She was detained for the admission but surely to be offered an informal one she had capacity to decide?

Hi, my mum is an ASW/AMHP (someone who does the assessments with aDr for people to be sectioned) from what I was told generally about the process I think She’ll be offered an informal admission then if she declines they’ll look at her capacity and see if they can detain her under the appropriate section of the MHA

People have the right to make unwise decisions so if someone has capacity they’re not sectioned I think.
I’m not 100%. But I think that’s right
