Does annual leave count as notice period?

I have to give 6 weeks notice in my job.
I work term time, can I hand in my notice at the start of the Summer holidays and this will count as notice served?

It sounds as if you work in a school. Holidays can only count as part of the notice period if you are paid for them. If you are only paid pro-Ratna in term time, then no. From another point of view, handing in your notice at the beginning of the summer break doesn’t make it easy for them to recruit someone else, does it?

I don't work in a school. I am paid for 45 weeks of the year, 39 weeks term time and 6 weeks annual leave added together then spread out evenly in monthly pay throughout the year.

In my experience yes, annual leave counts as notice period.

But you might want to check when your leave year begins and ends. So if 6 weeks is your full year entitlement, you won’t have them available to use all in one go. Unless your leave year refreshes on September 1st and you’ve saved all six weeks and not used a single day until now. Hope that makes sense.

If your leave year begins in January for example, then you’d only have 7/10ths of your entitlement to use before end of July.

I would check with your HR department. Your circumstances aren't typical.

For what it's worth, I have handed in my notice. I have a full annual leave entitlement to use up and I am expected to take during the notice period.

Yes. I did this in a previous role as I’d booked a foreign holiday (what are those I hear you cry?!!) It was a week of my month’s notice and all was fine.

Thanks for replies, I will check with HR
