my kid has been assaulted in school

Hello, my son is 15 years old, new to the school.
Very polite and kind but seems that he attracted bullies. Well ...
I will come straight to the point and question.
He has been assaulted by 5 older and taller cowards.
It was a premeditated action, police is involved and enough proof on video to understand how violent against my son they were.
The doctor and MRI conclude that he has injured brain Concussion after the assault.
Well ... the only action for me to take is taking this 5 cowards to court, not less that it.
My question is: what happen to them if they go to court?
What's the process ?

My son is a great little man, very kind and polite and I want to make sure those cowards will learn a lesson after that.
sad

I have no advice re: what happens, but just wanted to say I am so sorry that it happened to your ds. Hope he gets better soon.

longtompot · 14/05/2021 11:32

Sorry to hear what has happened to your son and I hope he makes a full recovery, both physically and mentally.
I can't help you with your questions, but I have read that you shouldn't post anything online about the assault if it is going to court. It can prejudice the case against your son.

Divineswirls · 14/05/2021 11:39

Just follow the police process. I'm so sorry this has happened.

Are you able to move your DS to another school ?

At my DC secondary school bullies like this are kept in a supervised room every break time for weeks. Their friends are allowed to visit them.

bellropes · 14/05/2021 11:54

Could you possibly contact Victim Support?
www.victimsupport.org.uk/

They'll be able to explain the process. Well done for taking them to court. These scumbags need to learn a lesson. We had to withdraw our ds from secondary school due to bullying. I hate bullies. I hope your son makes a good recovery.

miosmak · 14/05/2021 12:43

How awful 😞 Yes contact victim support ASAP

Bluntness100 · 14/05/2021 13:01

Op do you mean civil action and not criminal? In criminal you don’t take anyone to court. The police present the evidence to thr cps who make the call.

If there is evidence it should be a criminal matter.

I’m sorry this has happened to him and I hope he recovers fully.

LIZS · 14/05/2021 13:04

If there is enough evidence the cps will prosecute and your son will give a statement. Have you been led to think otherwise? Has he been well enough to be interviewed yet? Agree victim support and there may be a liaison officer assigned.

HercwasanEnemyofEducation · 14/05/2021 13:13

I hope you do get a prosecution.

Assume you have spoken to school and they have safeguarded your ds.

flapjackfairy · 14/05/2021 13:17

Oh how awful . So v sorry to hear this. Your poor lad.

Really hope you get justice .

Redrosesandsunsets · 14/05/2021 13:18

Gosh just whatevs you do, do not let him go back to that school. Just because school is school we need to break out mentality about them. If a woman is punched and assaulted by a man in the family home we see clearly it’s assault, and we recommend and suggest she leaves, gets out and stay safe and never return (not every woman listens but that’s the advice). Under no terms do we encourage anyone to go back there and live. Same with schools. Under no terms would I put my kid back there. That’s just abuse.

miosmak · 14/05/2021 13:28

there is plenty of evidence from the camera from school, witness and phone recorded aswell.

thank you

Victim support is not particularly great. Lots of inexperienced advisors

LIZS · 14/05/2021 13:39

Is the school taking action internally as well? If you are unhappy with that you can go to governors and Local Authority.

they are into more investigations as I think it clear what has happened and are talking to the cowards parents . The leader asked me when I am taking my son to school for him to plan what he will do to keep my son safe. The guys should be in Isolation but I don't know for how long.

I would have thought with an assault that serious that the perpetrators would be permanently excluded surely??? At least I certainly hope so!

Iworry2021 · 14/05/2021 13:54

Just wanted to tell you how incredibly sorry I am for what happened to your beautiful son. Definitely take them to court and teach them a lesson. I hope they go away for what they did or at least get a hefty criminal record. hugs

idontlikealdi · 14/05/2021 14:05

If the police are involved they should, as a minimum, be on short term expulsion, with a view to long term.

Hardchoices · 14/05/2021 14:05

If the police are involved surely the attackers have been suspended from school? If. It I would be raising hell with the head and higher up if needed.

Eivor · 14/05/2021 14:11

I have no advice but can’t imagine how difficult this must be for you and your poor boy.

He sounds lovely. I hope the little twats get what they deserve.
