Accused of posting on someone's LinkedIn...

I work in a public sector organisation and have been called in by my line manager to say that I have posted something offensive on someone's LinkedIn page and of causing offensive comments on twitter. Confused

I have a LinkedIn account but don't use it much, I do remember following and unfollowing this person a few months ago but no recollection of posting on their page. Is there a way I can check whether I commented without looking at their profile? I know they can see if I have looked at them and I don't want them to make any more allegations about me.

Thank you so much for checking in. I've been waiting to get onto my laptop to write an update.

My sanction was downgraded to a first written warning which is absolutely and obviously not what I was hoping for. They didn't seem concerned by the delays, the lack of disclosure and the lies.

So I have:

sacked my union rep for being ineffective.
put in a formal complaint about the errors in the process.
put in an ET1 for breach of contract.

I don't have legal cover with my house insurance so just working out what to do about that. I think I'll be able to find a no win no fee solicitor but I think it's the barrister that will end up being too expensive for me unless I can find a no win no fee one of them as well.

I've moved departments well away from everyone involved in the process and as a result my anxiety is a million times better.

I wish I had a better update but unfortunately not. I have taken huge strength from your support. Thank you.

now it's not "active" I do feel better although I feel incredibly "wronged".

I remember seeing this ages ago - I can't believe it's still going on (or at least hasn't been resolved properly yet) and that HR are so obviously ineffective!

Is it worth moving this discussion from chat to employment; maybe a lawyer will see it who can take a look for you? I wonder whether there are any lawyers doing pro bono work who would consider taking it on?

That is shocking. How can they justify a first written warning? Have you spoken to ACAS? What did the union say about your reps performance?

That is awful but presumably to give the written warning they’ve had to be prescriptive about what it’s for? Do they have any ‘proof’ whatsoever?

What was the additional evidence they brought that they hadn't shown you? How do they suggest this implies you made someone write a tweet?

It seems very suspicious, like they really need a scapegoat. Obviously you have to be a little oblique, but initially it looked like a suggestion that information was leaked somewhere. By now I start to wonder about who actualIy leaked it and whether they have a vested interest in you being found responsible. Sorry if I'm on the wrong track with this, is it something you've considered?

Not the update anyone wanted i think but better than the status quo? My union fees cover legal insurance (not UK) isn't it the same where you are?

I assume what happened was he never expected you to fight back. He doubled down. They backed him. They realised they'd fucked up and kept hoping if they made it hard for you you'd eventually drop it.

Did you know the person who said it/was it a random follower or someone with ties to you? Could Twitter not have been of help in confirming that the twitter account it was sent from was not your IP address/not set up by you/not a sock account?

But they have to have evidence? They would have had to have shown you a dated screenshot of the offending post, with your name on it?

Take this to a tribunal OP - it's laughable.

I think they disclosed offending screenshot of tweet to the OP late in the proceedings and as they cannot prove it either way, have accused them in an either/or scenario. Either you wrote this and this is your fake account or you know who did/gave them the info to reply to you and libel us/criticise us/bring us into disrepute.
How that accusation can be substantiated/stand up in court/upheld is beyond my ken. Unless it relates to info only the OP was privy to or is personal comment they can be connected to - even then, it's hard to prove. I guess it goes to likelihood (like Wagatha) but it is very scary that you can be policed in this way for others' derogatory comments.

@SequinsandStilettos has it more or less right. The investigation took so long that the account had been deleted by the time anyone actually thought to ask Twitter or do any proper "sleuthing". I can't prove it's not me because well, you can't prove a negative and by the time they had actually disclosed the offending message, the account had gone so the opportunity was lost. The screenshot of the offending post wasn't dated and it was linked to me by a mutual follower who had once wished me happy birthday- there is action evidence this mutual follower engaged with the offending post but that's what the assumption has been all along.

the info posted wasn't something only I could have known/confidential etc, it was calling someone incompetent. The person who reported it had played a part in a huge complaint in which I was a witness and he based his opinion on evidence I had given in that complaint. Again, not sure why he singled me out.

Because I didn't immediately "own up" to this mutual follower (they didn't give me a twitter handle or name so I couldn't) that was an aggravating factor. Plus the fact that they think I didn't show any remorse for the message posted online. Again... how I could show remorse is beyond me. I had no idea what they were on about!!

Much of that is just me whingeing but there is a lot wrong which my research tells me will mean they fail at ET.

I also have a new permanent GP who is brilliant so that's helped my general state of mind as well.
