Accused of posting on someone's LinkedIn...

I work in a public sector organisation and have been called in by my line manager to say that I have posted something offensive on someone's LinkedIn page and of causing offensive comments on twitter. Confused

I have a LinkedIn account but don't use it much, I do remember following and unfollowing this person a few months ago but no recollection of posting on their page. Is there a way I can check whether I commented without looking at their profile? I know they can see if I have looked at them and I don't want them to make any more allegations about me.

Definitely time to step it up a notch OP. I'd agree this is tribunal material now. ACAS are a good source of advice and can offer mediation before the tribunal stage. Just something to bear in mind.

They used evidence they hadn't disclosed to me, they didn't explain the delays, apparently I was found to be "directly or indirectly linked to defamatory comments posted on social media" which not only is impossible for me to defend, it bears no relation to the allegations I was told over a year ago.

Wow! They have really doubled down on their accusations!
I reckon they think (and hope) you haven’t got it in you to take it to a tribunal and will just let go. It must be unbelievably stressful but I hope you do find the strength to follow this one through with the help of the union. We are all cheering you on from the sidelines!

Did you find out what the baby photo thing was all about? It's all so odd. I appreciate you're not going into every detail but it doesn't seem like you've done anything wrong?

At this do you actually clearly know what you’re accused of? Whether it’s ridiculous or not, do you know what it actually is? I think you should either get a solicitor and deal with this properly, or just leave. They’re so clearly in the wrong, and your union are so clearly not capable of dealing with it that you either take the full legal route or just go.

Truly awful situation. Your union rep sounds useless, can you get an employment lawyer and go this way, I know it costs but it would be worth suing them to simply pay the lawyer.

I second this. I've often seen this thread popping up again and remembered it and come on to have a quick look at the latest comments, just to find it's still ongoing. I really, really hope you get some closure on this very soon. It's truly appalling how you've been treated.

I'm furious on your behalf, I hope you take them to the cleaners over this, they should never have been allowed to torment you over this for so long, and so incompetently.

This is awful. So you're still employed?
Are you able to consult an employment solicitor?
If you can arrange a quick call to decide whether to take this forward legally a timeline of events might be useful.
I know your union should be able to handle this themselves.

I can’t believe they have had the gall to do that. Check with your union what your membership covers, as my union would cover all the legal fees for a tribunal etc, so you might not even have to pay for it?

You don’t have to resign or be dismissed to lodge an ET1. It can be a 2nd appeal against disciplinary action or if a grievance is not upheld.

Correct, not all employmemt claims require the employee to resign, but if she's lodging an ET1 she needs a legal claim which an employment tribunal has jurisdiction over. An appeal is just an internal appeal - nothing to do with an employment tribunal. You don't just whinge to a tribunal that you're unhappy at work.

The most obvious claim I can see is (constructive) unfair dismissal, but she'd have to resign in response to the final written warning, or appeal and if unhappy with the outcome resign at that stage.

It's been a while since I read the thread, but I can't recall another employment claim (eg sex discrimination). She mentioned personal injury but that's not something an employment tribunal has jurisdiction over.
