Divorce

I have filed for divorce after 53 years marriage I am in the property as husband arrested for unreasonable behaviour. He is refusing to let me buy him out of the 90,000.00 property although I have gone down the route of 2 years seperation to keep thongs amicable. I am female 72 years old can I refuse to leave the property and make him take me to court. I have a solicitor but confused with it all

OP; absolutely - you have a right to stay in the house and if he’s been arrested for UB it’s very likely you could get an occupation order at court giving you total rights to stay in the house without him coming near it until the divorce is settled. Depending on your other assets you might then have to buy him out of his half or sell it and split the proceeds but this takes a while and your solicitor will go through it all. I really recommend taking the occupation order whilst you go through the divorce to give yourself space and peace of mind. Best of luck with everything xx
