Ebay seller

I ordered something on ebay and hermes declared it damaged and didn’t deliver it.

I contacted seller who said just wait. I replied saying I have proof it has been declared damaged.

He replies send the proof dont you understand.

I sent him the proof and no reply for the whole day. I sent the proof again and he said all your doing is moaning and I said it’s fraud if you don’t refund ( it’s quite expensive) I waited a whole week.

He replied back saying you moron and your dumb and said you can now wait around for any refund.

Bank won’t do any thing. Ebay wont step in till next week.

Anyone experience anything like this?

Did you pay with Paypal? You can open a case with them.

Also confused as to why Ebay wont do anything, they virtually always step in and side with the buyer.

Typically it’d be delivered to you, and then you’d offer to return it at their cost and get refunded. It’s a bit odd if you don’t have it.

The seller sounds abrupt. What does your proof look like? Have you got photos of the damage? If you have; eBay will step in - although I’m not sure what they’ll think of you not having the item - and you will be refunded.

@HopeAndDriftWood Hermes didn’t deliver it. The only proof I have is through the tracking. It says damaged parcel. Looked at hermes website and damaged parcel means they sent it back to the seller. Seller is acting like he doesn’t know what is happening. I didn’t recieve anything.

I wanted to dispute transaction through credit card but bank said to wait 15 days! They were not helpful at all

This is why I use PayPal. Simply open a case against him/her if you used PayPal to pay

Just wait until eBay will resolve the case I assume you have opened. Hopefully you opened an item not received case and as the seller cannot prove delivery they will find in your favour. I wouldn't bother trying to communicate with the seller anymore.

eBay will credit you back , also seller will just do it once you put the form in, they can't refund any earlier.

Ah, you've got to wait until the delivery date has passed. I know it's a pain, but wait until Saturday and open an item not received case. The seller may issue you a refund, but if not, you can refer it to eBay and get a refund.

Don’t bother with any more communication directly with the seller.
Just raise through eBays dispute resolution, they will side with you based on the damage reported by Hermès (include the tracking details and screenshot copies of the details from Hermès

The worst case scenario is the seller drags their heels for the maximum back and forth, if the seller is sensible then they will accept the claim.
You get refunded via the eBay dispute

The sellers claim is then with Hermès

I would take the eBay estimated delivery dates with a pinch of salt, what they show to buyers is very different to what it should show. They were telling my customers everything would arrive the next working day after posting when a 3-5 day courier was listed. I shut my shop for four weeks in the run up to Christmas because of it.

@tommika thanks for that. It’s just somehow caused stressed. Will just wait to call ebay and have proof so hopefully I get refunded.
