Tier 4 confused ( shared kids)

I’m confused .. so ex & I are both on tier 4
I live with kids but they also visit him at his place 2 hours away . So we live in Separate homes . Kids want him here for Xmas eve night .. is this allowed ? As in one of the exceptions?

Children can travel to different homes when parents are separated but I don’t think it would apply to your ex and allow him to stay over

Does he live alone? If he does, could you be in a support bubble?

That’s what I thought but he thinks that’s the exception .Apart from health implications I don’t want to be fined either

Yes he has been but has also stayed at a friends spare room till today .

I think the wording for that exception has always been something like "to faciliate contact between children and parents where parents do not live in the same household" rather than specifying it has to be the kids visiting the NRP. So if he doesn't have a home he can have them in, then I think you're allowed. I'd check the wording though.
