AIBU for not letting my lodger go on the council tax bill?

She’s under the assumption it will give her magical powers with regards to residency and it’s a better utility bill. I’ve already put her on the water and electric (2 by mistake) and she keeps on asking me to put her on the council tax.

She’s got an eu passport but from South America. Wants residency.

I’ve told her to get on the electoral roll as it’s good for credit checks/finding your last address etc.

I’ve given her a utility bill (was easy to add at 7pm on a Friday night and bill the next day).

She’s under the assumption that it’s going to help her open a bank account and the banks have already told her the water utility bill is fine.

I’ve lived overseas for many years and came back - so I’ve gone through this process.

She’s read that if you are in council tax arrears it can affect your permanent resident status - she’s read this as “if you don’t pay council tax” which she does, as part of her rent.

I’ve told her to get a driving licence as it’s good ID and address.

I just don’t want to feel pressurised into doing stuff because she disbelieves everything I say.

Again I don’t care lol. Just shows that bills are pointless. Housemate isn’t trying to fraud though .

@SuitedandBooted like most white people in South America her family are European

@PostItJoyWeek probably. There are a lot of HMOs around. Not sure why people would want to live with just the landlord....

Agh she’s not gone to work for a few days as well. So annoying.

@Georgeoftheinternet

Hey my sister lives in the house as well, so you can put a dampener on your single person discount rubbish.
So there's three of you in the house?

Really?

Hmm

Someone I know from South America obtained an EU passport in Poland.

Maze76 · 01/11/2020 13:46

Sorry, yes EU citizens do not need student visas, although, just to be aware this will change in the new year, which may be why she been asking you to put her on the council tax. However, like I said before, it’s nots necessary.

Sauerkrauted · 01/11/2020 13:49

If she’s applying for Indefinite Leave to Remain one of the documents the Home Office asks for in regards to proof of residency is a Council Tax bill (and any tenancy agreements). They say it’s optional but is “preferred” meaning you should have a good reason not to have one.

Georgeoftheinternet · 01/11/2020 13:49

@Maze76 she will only have been in the country for 15 months or so. Will she still get residency?

OP posts:
giletrouge · 01/11/2020 13:54

Why is she leaving it so late to be applying for residency if she's been here over a year? Are neither of you aware of the Brexit implications?

safariboot · 01/11/2020 13:54

This lodger is way overstepping the mark. They're a lodger, not a house sharer.

You've failed to set reasonable boundaries, and it'll be twice as hard to impose them now after your lodger has had it all her way. Your least bad option is probably get rid.

And bluntly, if you can't set and maintain reasonable boundaries and ground rules, you're not cut out to take lodgers.

MoonJelly · 01/11/2020 13:55

Issue is I need her money

So start advertising for a replacement now.

titchy · 01/11/2020 13:58

Yes. If an EU citizen lands in the UK on 30 December they will be able to apply for settled status. It doesn't matter how long you have been here, as long as you're here on 31 Dec and apply before July 2021. There's no minimum residency requirement.

FlitterMouse · 01/11/2020 13:58

Why dont you just ask her to leave and find another lodger.

Georgeoftheinternet · 01/11/2020 14:00

Thanks @titchy

How come she is working but hasn’t got a UK bank account? Is she being paid cash in hand? So presumably not paying NI or income tax.

Sounds like your entire household bends the rules and or alters the story to suit.

Georgeoftheinternet · 01/11/2020 14:02

@safariboot what are you going on about? I feel like you are making a lot of assumptions and setting a scene which hasn’t happened.

She’s asked to go on the bill, I’ve said no.

Please what do you need clarifying?

FlitterMouse · 01/11/2020 14:03

How is she being paid and taxed if she has no bank account

Georgeoftheinternet · 01/11/2020 14:03

@viques because she’s got an online bank account called Revolut. It’s not considered a U.K. bank but it’s very legal. And as I said before, she works for H&M so not illegally working or getting cash in hand.aoukds like you have no idea and fill in blanks yourself.

Georgeoftheinternet · 01/11/2020 14:05

@user1493494961 do you mean they obtained a polish passport whilst living in Poland or they were entitled to the passport?

Lots of people get paid into non-UK bank accounte, my partner did until March. It doesn’t have any impact on incone tax or national insurance. You can also be paid in cash and still pay both income tax and national insurance, your employer pays your wage in cash rather than via baccs.
Georgeoftheinternet · 01/11/2020 14:06

@giletrouge I think you need to read up.!

Well if she’s working for H and M she won’t have a job by Thursday. I think being asked to put her on the council tax bill will be the least of your worries.

viques · 01/11/2020 14:10

SimonJT I doubt a company like H and M is paying many of its staff in cash. Grin .

But apparently the lodger does have a bank account so that’s one anomaly sorted.

FlitterMouse · 01/11/2020 14:10

What will happen when lockdown starts next week. Will she get paid at all.

GrouchyKiwi · 01/11/2020 14:12

@Farle29

If she has an EU passport but is from South America and you know about this you will be storing up problems for yourself as chances are she is not legally entitled to the EU passport and you could get dragged into it when the UK officially leaves the EU on 31 Dec 2020. She will be trying to claim residency on the basis of being an EU citizen.
What bobbins. I'm from NZ but have an EU passport (as well as my Kiwi one). People can have more than one nationality.
