Estate Agent Selling Fees Question

Just asking on the off chance someone may know the answer.

I'm looking to make an offer on my friend's house, but it's listed with Foxtons.

Would they (Foxtons) still be entitled to selling fees if it sold privately.

Just checking before I make an offer.

Not 100% but I think she'd have to take it off the market first then you do the deal with her direct and they don't need to know.

She needs to check if she's got an agent that works on a no sale no fee system as not all of them do, if they don't then she'll still have to pay them.

Yes I’m pretty sure that as they have marketed the property they would still be entitled to their fee. Get your friend to check the contract it will cover this scenario

They would have to prove they were instrumental in her selling to you and you deciding to make an offer such as take you on a viewing or you only knowing it was for sale because of a board. Unlikely they would win the case. They have tried before and failed.

Thanks for the info. I was offered the property before she put it on the market and I declined (have emails to prove this). But circumstances have now changed.
