I am looking for some advice.

I bought an item from Facebook market place and paid by goods and services. It’s been 3 weeks now and I’ve not received the item, I’ve waited the time given by Royal Mail before you can claim the item has been lost. It was sent with signed for service. I chased the item twice with the buyer and she said to give it a bit longer and agreed if it wasn’t here by then she would claim against Royal Mail. Yesterday I messaged her advising that I’ve not received the item and she read my message but ignored it, so I decided to raise a PayPal claim. She has now sent me a message asking why and I explained why and now she is telling me that she isn’t interested and has she has a tracking number PayPal Will side with her.

I was under the impression that I would be covered if anything happened and that it would be down to the seller to refund me and her claim from PayPal but now I’m thinking I’ve lost that money and I paid the extra fee’s to send money by goods and service. Who is right next or the seller?

I've always found that Paypal go in the buyers favour to be honest, even if a tracking number is provided. Unless there's proof of delivery, they'll side with you.

Reason being, she is the one who sent the item (assuming she did) so she is the only one who can raise a claim with Royal Mail.

Post is occasionally taking a longer than normal at the moment, but is largely back on track I think.

It doesn’t matter if sue raises the claim with Royal Mail or not from your point of view. You paid for something you didn’t get. By law you have the right to your money back. The tracking number she gives will only serve to get your money back because it hasn’t been delivered. She is in for a shock as the money will simply be taken from her account

What does the Royal Mail tracking website say has happened to the parcel? That's likely to be what PayPal go with - does it say delivered to you or still in transit?

Then going on that RM message surely it's at the post office? Have you tried going in to the PO with your track and trace number?

She's Definitely wrong re PayPal, you did the right thing in using them as in my experience they side with the buyer in this scenario and will withdraw the funds back to your account if you raise a complaint.

PayPal will give your money back. She's telling you otherwise to try and stop you progressing your refund. Until the item reaches you it's considered with her.

Thank you. I have gone to the post office and they couldn’t find anything and I asked my post man and he had a look and next day he said they is nothing there for me.

It isn’t a lot of money but it’s just the fact that I’ve not received it and she is being quite rude about it. I messaged her yesterday and she read it and then today denied seeing it. I thought she might try it and took a screen shot of the message where it said read and she’s told me.

“I’m not interested in your screen shots”

I’m hoping PayPal side with me.

Anyone will a brain cell can see that the tracking shows that the item hasn’t been delivered, unfortunately for the seller this means that you need to be refunded and they claim against RM.

Alternatively PayPal may take pity on her and refund you out of their own pocket, as she did attempt to post it.

You will win the dispute though (unless the item magically gets delivered before PayPal processes the claim)

I don't think delivery companies are allowed to get signatures at the moment - not sure how relevant that is but as pp said there are huge delays at the moment

I’ve waited for 3 weeks so far. I know the postman can’t collect signatures but other items from different people have shown delivered or attempted delivery.

I had something similar. PayPal refunded me within a week and, I gather deducted the amount from the next transaction the seller had with them. He wasn't happy but that was his problem.

Why not call Paypal? The few times I've had a similar problem, I found that calling them was better as it's easier to explain and they acted immediately. They might say the refund will be finalised in a 'few days' but I refresh the screen while they are still on the phone and the refund is in my account.

Tell them what steps you've taken and that you can send screenshots of messages etc if they want them and most of all, remain calm and succinct. Not saying you aren't, but I know a person who started raising her voice to Paypal....there was no refund given in her case!

As other's have said, generally they decide in favour of the buyer. ;-)

As others have said, I wouldn't worry. PayPal will refund you. I always use paypal whenever available and I've raised a few disputes of this nature with them. Always successful. Just remember to keep a screenshot of everything for evidence, including your messages with her and the post tracking.

The seller is bluffing and very rude too.

Yes they replied at first they said they could not refund as the item was still in transit. I took screen shots from Royal Mail saying that it should only take 2-3 days and that they class they item as list after the initial delivery time plus 10 days and they come back and refunded me.
I so wanted to message the lady who sold it to me and told me that PayPal wouldn’t refund and say “so they wouldn’t refund and side with you” but I didn’t.
